Just Found my 221g Ticket

I was reading on different websites about how consulate would treat case of 221g or AP. I've got mine when went to interview for tourist visa more than a year ago. My question is, how long 221g would be expired? And do I still in AP when fil form DS156?. The reason why I'm asking because one item on form says," have you ever been refused visa to USA?" here information about 221g according to US Embassy in Jakarta . Thank you for advance.

Timeline

All I know is you need to disclose the fact that your visa application was rejected at the Jakarta consulate, when you fill in form DS156.

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

I've got green form. It says:

"Section 221(g)" IneligibilityIf you have received a green or yellow document, your NIV is not refused, but we suspended action under section 221g of the INA because more information or time is need for processing.The green document tells you what information that you must provide so that we can continue processing. We are waiting for your to return with this information. If you do not provide this information we will take no further action on your NIV application. The burden of qualifying for any visa rests solely with you. We will resume action on your application only after we receive information from you that the consul has requested.

Okay, my next question: So is it different between rejected and refused? Because on the information says that my NIV is not refused. I've got green form or ticket or whatever people call it is.

If we were talking about pure terminology, "reject" and "refuse" mean the same thing (at least to me), but I have never been refused a visa from the KL consulate. Gotta wait for a more knowledgeable VJ-er to respond. :thumbs:

December 2009 -- Visit to Malaysia.

March 2010 -- Visited US.

Thank you. But based for what I reading about my NIV, it says my visa is not refused either because I have green form. Curiously, I was trying to search "rejected" word as you said before from explanation on embassy website but could not find at all. So maybe US Embassy in Malaysia use it, who knows. I'm not an expert for immigration law to explained it.rofl.gif

I was asked about how long 221g would be expired and what condition can be applied to me if AP limited time ever been existed. I hope another VJ members have brilliant insight and experience through this 221g process. Again, thank you for share your thought.good.gif

Are you worried that this may affect your K1 visa application (when your petitioner sends it in)? Just wondering.

About the words "rejected" or "refused" at the KL consulate -- I have no idea, because like I said, I have never been rejected OR refused ;) But they probably mean the same thing everywhere. Probably.

I would say not "worried" about it. I have to prepare all many possibilities would happened in the future. My fiance and I really be careful for the next step. He even spoke to military lawyer about our process - which is I'm not interested talk to lawyer- He said it's not harm talk to them since military provide it for its members. I would rather talk to people who already have been through this process on this forum.

That's why I'm concern small things not worried. I always thinking worst things could happened in any day even though usually is not as worst as what we thought when finally it was occured. I'm just wanted to be well prepared and not stop in the middle of K-1 process just because of small things that I've could anticipated earlier.blush.gif
