no visits after marriage = denial of visa?

Hi all. I'm just wondering a few things....

1. How necessary is it to be with your spouse during the consulate interview? I'm getting married in India this month, and will be filing my I-130 shortly thereafter. I've already spent a summer with him (over 2 months this summer) and now will be going back for 10 days in November to get married. We have known each other for over a year now. However, due to my schedule, it would be nearly impossible for me to go back to India next year. It will be terrible to be apart, but we don't have too much option... as I'm in a professional degree program, and I can only get weekends off (the following year) and not a full week to go there. So that's why I'm using this current 2 week break to go there and get married, as next year I wouldn't have the opportunity.

2. Is there also really a strong chance that he will be denied a visa if I have not visited him after the wedding (for 9-12 months until his interview)? I really wish I could be there. :(

3. Also, since I'm just about to leave for India in a week's time, is there anything I can do while there to build a stronger case for us having a bonafide marriage? I will get a few letters from his family members in support of our marriage. And I'll include several pictures of the wedding. (I even have our engagement photos from my last trip, and may include those as well.)

By the way, my (soon-to-be) husband will be having his consular interview in Delhi.

Not necessarily, it depends on the totality of circumstances and the other factors involved in each individual case. My husband and I didn't see each other for nine months after marriage and it wasn't an issue at our interview. I was alone at the interview and while the question was asked as to why he hadn't visited me after our wedding, my answer was accepted as sufficient.

Be warned, NWD is a b!tch consulate to deal with.

09/29/2009: I-130 NOA1
01/25/2010: I-130 NOA2
03/23/2010: Case completed.
05/12/2010: CR-1 interview at Mumbai, India.
05/20/2010: US Entry, Chicago.
03/01/2012: ROC NOA1.
03/26/2012: Biometrics completed.
12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

12/20/2013: Oath ceremony

rkk1 - You are going there for marriage. PLEASE

Goto Amercian Embassy and American Citizen Services (make on-line appt)...

And get "No Objection Certificate" from them.... it is about US Citizen getting married to Indian Citizen.

Have your and his information with you and add it to the letter (they know what to do with it).... It will help you big time during immigration process.

There are some marriage registrar ask for "No Objection Certificate" too. It is better to have it.

Sachinky - thanks so much for the warning about the Delhi consulate. We will have to make sure our petition is done well to avoid any issues.

Deep - thanks for reminding me about the No Objection certificate. I got it from the consulate, and you are right, that it did help us to obtain our marriage certificate. This was good advice. :thumbs:
