Congratulations! I really hope they are... CSC received our file December 21 apparently, so we're officially over 6 months now too. Maybe I'll call tomorrow. I'm not sure what to say - it's been so long since I've had to call USCIS.

I'm mostly nervous because if they keep dragging their feet, my medical may get thrown out. It was done June 15 of last year, so they're cutting it very close. I really don't want to have to do another one, especially since July is already busy enough with our trip to Canada.

Somebody correct me if I am wrong but I think as long as your medical was still valid from the time you sent in your AOS paperwork it will be good throughout the whole process.

I just got the email and text that Pui's card is in production! After I read Prettysunshine's post from ealier today I looked online and was still in Initial Review. Now when I look it is in Production!

That's interesting, how did you find out it was transferred so much earlier than stated?

We didn't receive any receipt of it arriving at CSC either.

The customer service rep told me how many days it was over the 180 day mark when I called in today. Apparently it is assigned to a particular officer already, although a name wasn't given to me. Must be the same one many of us are stuck with, while the pile of boxes languishes behind their desk

Yes, it is discrimination because when she went in for her interview with the company they saw she did not have a green card and said "call back when you have your green card". Unless that job had something to do with national security then they cannot pick and choose which document they can accept. I also do not think the job was for national security because it is just an assembly job in a factory.

Did you file a charge of discrimination? They are not even allowed to ask what authorization someone has until after the job has been offered and accepted!

I wanted to but Pui does not to because she knows a friend who works there and her friend recommended that she apply over there.

I can understand why they'd be reluctant, but it's annoying to read that Pui was treated that way. Hope the Green Card changes all that. Good luck!

If they're not allowed to before hand, then just about every place my wife talked with violated that law. None that I'm aware of would not accept an EAD over a green card though. Watching my wife search for a job and finally get something, I've become aware of a lot of discrimination towards immigrants. One well known accounting placement agency had someone actually come out say to my wife, we don't place new immigrants. Go get a job first and gain experience here before we talk with you. This was after she had been in contact with someone else in the company that said to contact them when she got her EAD. I tried to get her to call back again and get a different person, because she didn't remember the name of the original person, but she had gotten totally discouraged by just that one person.

That's what it says on the USCIS webpage...

Employers must not:

• Demand that an employee show specific documents
  
• Ask to see employment authorization documents before an individual accepts a job offer
  
• Refuse to accept a document, or refuse to hire an individual, because a document will expire in the future
  
• Refuse to accept a receipt that is acceptable for Form I-9 purposes
  
• Demand a specific document when reverifying that an employee is authorized to work
  

But in reality, if asked what can they say? "Not telling!"?

Thanks. Pui had her medical done back in April 2011 and she was just approved so it did expire during her AOS but it was after she already sent in the paperwork. I hope that helps you.
