Turning in K-1 application tomorrow; can UK fiance come visit me next month?

It's my first post here. :)

We have all the K-1 application packet materials ready. I'm planning to send them to the Dallas lockbox tomorrow.

Can my fiance come visit me in the states in December or will they already have taken his passport? I'm so new to this and so confused.

K-1 Visa

November 14, 2011 - 129-F mailed to Dallas, TX lockbox

November 15, 2011 - 129-F received at Dallas, TX lockbox (signed by B. McBride)

November 21, 2011 - Payment of $340.00 cashed via USCIS

November 21, 2011 - NOA 1

February 15, 2012 - NOA 2 (86 days from NOA 1 to NOA 2)

The passport is taken at the interview to stamp the visa in it. Thats not for another 7-8 months.

It would be a good idea for you to check out the flow chart for K-1 it explains the steps in the process.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Don't let him apply for a tourist visa to the US. It will likely be denied if there is a K-1 application in process for him in the system.

If he can use the Visa Waver program to enter the US, he may be denied at Point of Entry. I don't know if how often that happens. One of the more experienced posters can probably answer that.

UK citizens do not require a visa to visit.

OP, your foreign fiance may visit you. I suggest he bring strong ties to the UK to prove that he is not moving to the US before he is legally allowed to. Things like school schedules, copies of a lease, letter of when he's expected back to work, etc. Anything that will show he has responsibilities back home that he is not abandoning.

He MAY get denied entry to the US, but even if he does, that has no negative impact on your Visa application as long as he is honest about any denials.

People visit all the time while their K1 visa application is in process. Being honest with any questions asked about his visit and having strong ties to home will help immensely.

I joined my husband 3 days after we filed for K1.

I took evidence of 'ties to the UK' but CBP didn't ask for anything other than my return ticket. Don't take anything in your luggage that might suggest you are staying, like documents you don't need or a wedding dress :) You should be fine. Just be prepared for the worst.

04-2011 I-485 Approved.
