My name is Bryan Garcia, I am 25 years old US Citizen and I met a wonderful woman in Mexico and while I was aware of the whole K1 visa deal I was hard headed and went ahead and I departed to Mexico to be with her, we got married on Aug. 02, 2011, now I am here living in Merida, Yucatan but I really want to go back home with my new wife. And on top of that my tourist visa here in Mexico is about to expire and I don know what to do

Please help and tell me what to do... and if investing in a Lawyer is a good idea or not?

Go back to US and file I-130 (CR1) petition and if you are prudent, you will be able to get your wife in 7 - 9 months time.

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

You won't need a lawyer to do this if you are at all capable of researching and understanding what you need to do. This site is an invaluable source of experience and direction for individuals in your situation.

Unfortunately, time apart from your wife will probably be necessitated.

(...Husband needed passport for personal reasons during this time...)

May 1, 2012: Visa in hand
May 31, 2012: POE at Montreal's Trudeau Airport
Early July: Physical Green Card received in mail. Yes, it's green!

March 13, 2014: ROC filed (went to VSC)

April 22, 2014: Biometrics appointment

December 9, 2014: Case inquiry initiated

December 11, 2014: Response: "The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required security checks remain pending."

March 14, 2014: Received NOA that approval had been given on March 10; expect new GC within 60 days.

Marrying her while you were in Mexico isn't a problem but just as with the K-1 you will have to go through the process. The upside is that you can more easily visit her than a lot of us could visit our spouse. Another upside is Mexico does EP so it streamlines the whole CR-1 process. You need to read up on the CR-1 visa and go over it with your wife so you guys know as much as possible. As for an attorney that won't be needed if your case is routine. If there is something in either of your backgrounds that could cause an issue (domestic violence charges against you, drug trafficking for either of you, previous immigration petitions, illegal entries or overstays on her part, etc) then consulting an immigration specialist would be advisable, but even then, you have to be actively involved in everything. Don't make the mistake that many have in assuming you have paid an attorney so they will handle everything.

Oh and if you haven't already, take lots of pictures and keep copies of everything. Receipts, boarding passes, chats, emails, phone logs, pictures with family and friends. Anything and everything to prove the bona fides of your marriage. :thumbs:

"Electronic Processing" meaning just about everything can be submitted via an online site and through emails rather than packets being mailed back and forth.

While you do need proof of your relationship, CDJ is relatively easy so don't go overboard, but you MUST follow their instructions precisely--there is no room whatsoever for your judgment--they are the busiest consulate in the world, and you must play by their rules.

As to Mérida, we are thinking of moving there in a few years--it is a wonderful place.

it is true what they said. I was planning to pay a lawyer when I found this site. (GOD thanks)I filled out all the papers by myself 8/17/2011 now waiting for an interview date. follow the instructions you will be fine

If you are a regular VJ user and visit different forums and post regularly then definitely this is a much better option that hiring a lawyer the difference is that here you are getting the same advice that too for free...
