Fiance visa petition returned to USCIS

Hi All,

I am going through one more damn stupdity by USA embassy below is my story.

I have given my fiance visa interview on 21st oct my case was solid and genuine but visa office seems to be pushy and she did not want to approve it so somehow she aske dme a stupid Question

to provide some docs which i have already done , the day i submitted my documents she was not available and clerk took it and told they will let me know ASAP

which they never did until i sent emails back and forth and got their reply --> " This office has returned your petition to USCIS for possible revocation. Please contact the USCIS office that adjudicated your initial petition should you wish to check the status of your returned petition." now my question is what can i conclude from this is my visa denied ? anything else from here onward i can do to get it going and i can get my fiance visa???

Please suggest i m pissed off completely,,,,!!!

What embassy/consulate conducted the interview?

What documents were you asked to submit?

From what you are stating the interviewing officer did not see a bona fide relationship.

it has happend at singapore embassy That VO is not good at all she has been doing it with most of the people, my relationship is from 6 years and every document was in place with loads of proof, one of them was my fiancee dental card and her dental appointment form that i got when she visited me in singapore i just showed this coz wanted to prove that she stayed with me and i got this dental card for her being my domestic partner from my employer, VO wanted a letter from my company to state that i got my fiancee this dental card insurance thing without being married which i submitted , it is real stupid that what i saw everything is fine relationship is 100% real just denying it because they do not want to give it hell stupid , my interview was 45 minutes long she asked me hell alot of questions how come they can returned it to USCIS? even they never updated me on this until i kept sending them so many emails.

alos i want to know where can i check with USCIS about my petition and what does " USCIS for possible revocation" means ? does it means my visa has been denied?

Sorry to read what happened to you...

Your package will be returned to USCIS. Here the petition will most likely die (from expiration) or you can attempt to appeal.

Here is where it becomes sticky. Most of the time it is quicker to reapply than it it to appeal. BUT if you do not correct the deficiency that caused the first denial then you've accomplished nothing but waste more time and money. Same thing if you choose to marry in Sinapore and file for CR-1. If you do nothing to correct what caused your denial in the first place, getting married and filing in CR-1 will not work either.

Most petitions are returned to USCIS because of lack of proof of bonafied relationship. It should spell out the reasons for you on the papers provided by the Consulate.

CORRECT whatever caused your denial before you appeal or reapply.

Visa issuance is done at the embassy/consulate. At this point you are far from a visa approval.

It was returned for one of two reasons...

1. The consulate feels USCIS made a mistake in approving the petition in the first place This is not your issue. In this case USCIS reviews and either agrees with the consulate or re-affirms it and sends it back to the consualte for a new interview. I doubt it is this issue because they spent too much time with you. If this had been the issue they often would have returned it even before you had an interview.

2. The consulate feels you do not have a valid relationship or it was formed for the purpose of immigration In this case, the fastest, easiest and cheapest way to try again is to file a new petition and do a better job of preparing your proof of relationship. Filing again is actually pretty good proof in itself. But whatever you presented before...present MORE and be especially careful to keep records of ALL communications, etc.

There is nothing else you can do that would be easier, faster or cheaper. You can easily find a lawyer that will TELL you their is (for a fee) but there is not. You have nothing to appeal, you are not entitled to a visa and the consulate is fully within their authority to reject it.
