Employer and ex wife documentation

My boss has informed me that it is against company procedure to produce a letter of employment. They gave me an 800 number, for a third party company, so the CO can call.

Tomorrow I will go to my credit union and hope they will give me a letter for the I-134

paperwork. I have also contacted my ex wife about a notarized letter stating that we are not and have not been living together since before our divorce in 2000. She said "no" because her name is private. :rolleyes: I am interested to know what others have done about getting something for this situation with an ex wife. Should I worry about having proof of not living with her, since before our divorce in 2000, for the HCMC consulate?

Typically the Consulate is NOT going to call to obtain items which are the responsibility of the petitioner or beneficiary to provide and letters of employment are more important to some Embassys than others. I would recommend that you approach your immediate supervisor and ask again, telling them the importance of the letter to your interview.

If you can not obtain a letter, I'd provide as much employment information as I could, such as 401-K statements for the past several years if applicable, a copy of your business card, MANY pay check stubs and of course, W-2's for the last several years from your employer.

As far as having proof that you have not lived with your ex - that is the purpose of the divorce decree, which you provided in the I-129F petition. If that was not acceptable you would have received a RFE for an absolute decree or other documentation pertaining to the divorce. A notorized statement from your ex spouse is not needed.

Thank you az110965 for your quick response. Those were my thoughts exactly about the divorce decree and with my employer there is not changing their minds about anything. They hire third parties to handle all aspects. I think there are four stages to get somebody hired and the first three are through another company and that part takes about 5 months. My mind as at ease and I have all of my tax returns and transcripts. Thank you again for your knowledge.

Always happy to help in anyway possible, but you do need to know that some Embassys weigh the letter of employment more than others. There have been postings in Embassy reviews in which the Consulate never asked for or even looked at a letter of employment and only considered tax returns and W-2's. Other reviews stated that the Consulate ONLY looked at the letter of employment.

Hopefully someone that has interviewed at your Embassy can give more specific information.

As far as your employer not being willing to write a letter, do you have something in your company handbook which states that this is their policy? If so, I'd provide that. If not, then I'd ask your HR department to issue a letter which states they do not provide letters of employment (kinda back handed, but in a way they'd be providing one and not even know it).

Another possibility is to ask them to issue a "verification of employment" which is a standardized form that a company provides to a bank for the purpose of you getting a mortgage. This is basically the same information that they'd provide to the Consulate anyway, just in a different format. I can't imagine your company would have a policy against issuing a verification of employment if you were in the process of buying a house.

All embassies/consulates are not the same. In the case of couples going through HCMC documentation about ex spouses is a fairly common request.

Regarding the employment letter my guess is that the person you asked does not understand what you are requesting. You may have not explained it well enough, or the person wasn't listening closely. I suggest that you write a sample letter for them to see exactly what you are and are not asking for. Likely your employer wants to avoid creating any document that could be used against them in an employment / termination dispute. What you are looking for is a letter with your job title, pay rate, average hours worked if applicable, and date of hire.

If your employer (and the outside hiring service) refuses then be sure to send several months worth of paystubs to support your income claim. If your income is sufficient then there is no reason to get a letter from your credit union. Other assets will not be needed.

If your ex refuses then you can do what I did. Submit a notarized affidavit stating all the pertinent facts about when you and where you last lived together along with where you ex has been living since you separated. If you are not sure of all of it, give as much detail as you can. Also include in your statement that you asked your ex to provide an affidavit and that your ex refused to do so. Another thing you can do to confirm your ex's current address is to send a registered letter (or an overnight UPS/Fed Ex letter) with return receipt. That way you have some thing signed by your ex at that address. Submit that as well.

Don't get lazy preparing the documents for HCMC. You need to be well prepared and to the best of your ability anticipate all the usual issues that arise. Well prepared submissions and evidence lead to first time approvals. Sloppy preparation leads to RFE's and the accompanying stress and delays.

Get a print out of your x wifes address off the net , that's what I submitted for evidence never questioned. I had hard time getting employment letter from my part time job.they ended up just giving me an hourly rate and start date. Sometimes I wonder how close they look at that. I brought over my wife and her two children and have 3 kids of my own and they never questioned my ability to support a large family, granted I made more than the 125% but it wasn't like I was way over the thresh hold. Give me a holler some day..
