K-1 denied for SSN

Timeline

Jenni went to the SSA office today in Manassas, VA and they proceeded to tell her she could not have a SSN until she gets her green card. She showed them her I-94 card that has plenty of time left since she's only been here for 2 weeks now so that should not be an issue. After protest the lady talked to her manager and came back with the same answer. Can't get one. We are already married so is the I-94 still valid for SSN?

I told Jenni she may need to try another SSA office, but she is stressed out from the experience. Is this something I can do for her? Any suggestions?

There is a memo you can print out and take with you. We the beneficiaries are entitled to a SSN if our I-94 has not expired.

The exact same thing happened to me. I knew that the officer was wrong so I sent an email via the Social Security website and got a fairly prompt reply and then a phone call. After some information from the officer I was told to go back to the officer and provide the office with contact details of the person who called me if I had further problems. She was reluctant to apply for my SSN again (she deleted my previous application), and I was approved right away the second time and received my card about 10 days later. If you still have problems getting the SSN I would recommend emailing them from their main website.

Same thing happened with me. I e-mailed Social Security and they told me that it is allowed to apply as long as you I-94 is valid. Print out the e-mail, then go back to the office. Good luck!

Unfortunately SSA employees don't always know all their rules. You shouldn't have any issue. As others have said you can call the main 1800 SSA number, or email someone online.. basically you need someone who DOES know what they're doing to talk to someone there to do their job.

'im assuming you waited the two weeks to make sure dhs put the info in the computer eh? sometimes it takes a bit for that part, and they wont find you, but in your case it sounds like you just went to a doorknob of a center that doesn't teach its employees a damn thing.

when it comes to this countries immigration departments, i swear they hire them all out a damn cracker jack box. .....

Yep we waited the 2 weeks first. We've received a response from SSA's email with some ammo to show the local SSA. Hopefully it will satisfy the hired help. :bonk:

Which office did she try? I did mine in Fairfax off 50 and they had no trouble - mind you that was a couple years ago - every once in a while someone runs into trouble because the SSN office doesn't understand. Definitely print off the info someone linked..it's from their own darn site I think :)

Good luck! Hopefully that will take care of it. I had to escalate mine to a supervisor who just so happened to be familiar with K-1 processing. I feel her pain. It's very frustrating getting reestablished in another country. I'd try Udella's suggestion at Fairfax. Manassas seems to be a pain in the butt for pretty much everything.

Looking forward to hearing how the second attempt went, Paul & Jenni. Were you able to apply for your AOS before getting the SSN?

Yes we applied for AOS, EAD, AP prior to getting Jenni's SSN. You don't need one for those.

An update on the SSN application. We had someone from the SSA main office call us and once he talked with Jenni he was shocked at what she said they tried to do. The hired help actually tried to remove Jenni's I-94 from her passport. Jenni had to tell her to stop 3 times. The lady was picking at the staple with her long fingernails trying to see if there was some number underneath that she wanted. When Jenni tried to explain that the numbers she wanted were the hand written ones on the back of the I-94 the lady said she couldn't use those. "Anyone could write those in there".

Anyway the guy from the main office called the manager at the local office and "educated them". Jenni went back after that and they processed her correctly this time and she had her card in 2 days.

Note also that we waited until after we were married to get Jenni's SSN so that it was in her married name. If you do the same all you need is your marriage certificate to show them.
