Tragedy! Visa Denied!

Bless for us! It looks finally the Consulate begins to listen after my desperate efforts to reach them. In all likelyhood they will give my wife a second chance of interview. I hope soon and I hope this time she will be well prepared. I am not letting my guard down and I will continue to push until we are reunited, but I will sit back a bit and wait to see what happens. I will be in Guangzhou soon.

They see red flags, fine. They can scrutinize but they need to give us opportunity to demonstrate our case. Thought my documentations were enough but they were not as they were not looked at much.

Lesson: Don't count on just documentations or just interview. Count on both and make sure with just one of them you can still demonstrate your case. Make sure the documentations are good enough that even without an interview your case can stand by itself. And make sure you can do so well in interview that even if there is zero documentation, the interview itself is enough to convince the visa officer. Leave nothing to chances!

The VO asked, at one point, something about my wife's "fiance". Maybe he did not realize we are a married case, not a fiance case. Maybe that's just a slip of tongue?

10-07-13 - I-751 divorce filer paperwork journey begins

07-03-14 - ROC interview - approval pending delayed background checks

07-25-14 - APPROVED! 10 year GC is finally in production!

Unfortunately my wife did not pass the visa interview. She waqs denied for non-bona fides relationship.

I just could not believe it!

I should have known. I did not make enough effort to urge my wife to spend time preparing for the interview. The VO is probably not very satisfied with some of her answers.

I will have to spend a lot of efforts to fight this now.

I'm so sorry to hear your sad news... Don't give up -- don't ever give up!!! But you should also pray pray pray... everything is in God's perfect time and will!!! It's not how many times you fall but how u pick up the pieces and start all over again... this time more prepared and confident... Good luck and take care! :thumbs: :thumbs:

09/06/07: Went to the Philippines to marry my fiancee.

11/29/07: Wedding Day!

11/30/10: Going back to US, to get my wife!

05-06/11: Sent & Received Congressman's letter & advice.

06/23/11: Found and joined... VisaJourney.com!

06/27/11: Filing “Form I-130 IR-1” and Expediting it with Humanitarian cover letter.

07/08/11: Mailed I-130 to P.O. Box 804525, Attn. EXPEDITE I-130 SPOUSE, Chicago, IL.

07/18/11: Received Hardcopy Form I-797C or NOA1 in mail, receipt date 7/13/11 and priority date 7/12/11.

08/08/11: Called USCIS 800 number to check on status.

08/23/11: Request for Expedite Approved. Received NOA2 dated 08/23/11.

09/09/11: Called NVC they got my file from USCIS.

09/13/11: Received NVC Case# & IIN# (via email) & emailed DS-3032 from PI to NVC.

09/14/11: AOS Fee Paid Online (status PAID on 9/15 also at this time IV Fee Bill Generated)

09/16/11: IV Fee Bill Paid Online (status PAID on 9/19 and printed Barcoded Coversheets)

09/20/11: Express mail both the I-864s AOS and IV DS-230 (arrived 9/21 NVC)

09/27/11: Case completed file shipped to USEManila; arrived 10/3

10/13/11: Medical passed/completed today but still NO interview date yet?

10/16/11: Called USEManila file ready! Called Appt. Services set up Interview Date for 11/9/11.

11/09/11: Interview. But had to comply with 221g, re-verification forms CENOMAR/NBI.

12/02/11: Visa approved but delivered 12/7/11.

12/12/11: POE – Detroit.

10/15/09: Paid both AOS & IV fees

10/16/09: Received email electronic filing accepted

10/18/09: Sent AOS via email

10/23/09: Received email that AOS was accepted and waiting for IV

10/27/09: Sent IV via email

11/10/09: Signon to payment failure

11/19/09: Received email for interview - December 14th

12/14/09: Approved for Visa

12/16/09: Received Visa

I got one email from Guangzhou IV reassuring me that they are doing Administrative Processing on my wife's case file and they will NOT send the files back to USCIS before it is finished, and "not before we call your wife in for a second interview". I also got conformation that the appeal document I send via ACS had some how made its way into the interviewing officer's hand. So hopefully they have listened to me and they will give my wife another chance.

I would not discuss precisely what I did, at this moment, for obvious reasons. But it helps to try to be calm and rational. It would not help to be too emotional.

Apparently you sent an "appeal document" visa ACS and the IV unit has confirmed there will be a second interview prior to returning the petition. Sounds like it worked at least to get the second interview. I'm guessing a politician was also involved. good.gif

Immigration history of ex-wife should not be an issued. I did petition for Ex, in 1994, and she came over in 1999. That's long time gone.

That should not be a reason for suspicion. It's perfect normal for people to not remember all details of historic event

There is no law saying a US citizen can only get married to a foreigner no more than once. I understand that if you bring in a froeign bride once every two or three years that's definitely a no no. But that previous marriage lasted a good 16+ years and it was bona fide, not for green card.

It would have been nice and much easier if I find a local girl to marry. I thought about that. I thought I was attracted to caucasian girls and thought about the possibility of inter-race marriage. But it didn't seem to work. I am still more comfortable looking for a company within my own ethnic group. Nothing wrong with that. Most posters here find that one way or another they would rather marry some one from a foreign country, than find a local spouse.

At least the US constitution still says that citizens have a right to pursuit their happiness however they want, that includes bring a foreign spouse in to start a family here. There is probably a limit at some point, if every one go out to bring a foreign bride in. But we are talking about about 50 thousand foreign brides be brought in a year, versus a population of 310 million, versus 4 million new babies be born here each year. If we hit a limit that citizens are limited to bring foreign spouses in, then we will probably be at a stage that we should impose mantatory borth control on the citizen population, or things of that nature. We are far from that!
