Tragedy! Visa Denied!

China is an immigration fraud country. Just like India, Pakistan or the MENA countries. It is what it is.

I am not the C.O. don't vent at me. We are all trying to help you. You said that you assumed since you front loaded the application that you would be fine. Break down the word assume- A$ U Me. Don't take anything for granted in the immigration process! Darnell and Pushbrk time and time again state how tough of a consulate GUZ is. You rolled the dice and sent your wife in there blindly. These people ask anything. You have a past divorce with a person from China that has gone thru this immigration process and has recived their green card. This is a red flag. Nothing against you on this but you have to face the harsh realities that this red X is on your record.

Having a good source of income in irrelevant for this as you have a red flag already. You should have talked to your wife about this. Your wife might not care for the details of your ex-wife but for the immigration interview she should have known a good amount about her.

I wish you all the luck in getting all this sorted out and get the visa for your wife. As others have suggested, it's time to get a lawyers help on this matter. Best of luck to you. I'm hoping and praying for a quick turn around for you! :)

Sorry Palladin, our hearts go for you and your wife but Dev is right - you have been quite active on VJ and I can't comprehend this. It is time to get hold of yourself and start taking some concrete steps to address this issue through some lawyer or ....... We wish you all the best and will pray for you.

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Document wise I have covered everything I can think about: previous marriage, why re-marry so soon, etc etc. The point is they simply would not read the documents. It's my fault that I did not prepare my wife enough. I would thought they would question her like any normal couple. Things that a normal couple knows, my wife probably knows. Things she doesn't know or is unsure, a normal couple would not do better either. Reading recent interview successes where they ask 4 or 5 routine questions and that's it, really let my guard down.

A painful lesson learned: Never let your guard down. Prepare it as if it is a one hour interview, even if it turns out to be one minute. Another lesson is don't count on the documents alone.

The VO was probably looking at the whole picture to make this determination, not just the questions about the ex. Something generally triggers them to go down a line of questioning like that, for example, the lack of time spent together. You married someone from across the world and only spent 3 weeks with them. So you've got only 2 visits, you weren't there at the consulate for the interview, and one prior to marriage from China before. It seems that will fly in the Philippines and elsewhere, but not China. They are going to probably drill her hard with questions. If she seems unsure about anything, specifically things she should be prepared for, then your wife is going to have slim chances for approval. Get lawyered up.

It is painfully obvious why VO denied her. She was just ill prepared, totally not expected to be grilled on so many questions, thinking that I have prepared all the documents covering everything. She really regret not listened to me and not spent due diligence time preparing the questioning. She is heart breaking now and I can't blame her any more. She is so young, inexperience. People who witnessed her interview saw her visibly shaking. Nervousness caused her to answer two trip duration questions wrong. She knew they were wrong but some how they slip out of her lips.

Now the question is how do we remedy things up.

Q: Where is he from?

A: From San Diego

Q: How do you know each other

A: Through a web site

Q: What web site

A: XXX

Q: Who talked to whom first

A: He talked to me first

Q: Have some photos

A: Show photos

Q: Where do you live

A: XXX in Guangzhou.

Q: When did you know each other

A: ## of ## in 2010

Q: When did you meet first. How long he stayed?

A: 23rd the Thanksgiving of 2010. One week [wrong].

Q. How many trips he made back to China

A: Twice

Q: How long have you known each other.

Q: When did you get married?

A: ## of ## in 2011

Q: Where do you go after wedding. What have you done?

A: In Guangzhou. Shopping in Tee Mall.

Q: How long did he stay after marriage.

A; Ten days[wrong].

Q: How did you communicate.

A: Through internet and telephone calls.

Q: Did he ever come back after marriage?

A: No.

Q: How old is his Ex-wife? Other info about his Ex-wife?

A: Four years younger than him. They have two kids.

Q: Information about his Ex-wife?

Q: Which country have you been to? When? For how long? What was the trip for?

A: Thailand. For tourism. One week.

Hey - I do feel bad for you in one huge aspect -

sometimes we do 'peer review' here of a casefile -

where you tell us everything, and we mention red flags that you'll have to address; usually we do this prior to an I-130 submittal.

Red flags are addressed in two places:

1. Evolution of Relationship letter and/or a seperate letter of attestation (one per red flag) submitted with the I-130 and

2. Interview Day, in the form of Questions and Answers between the VO and the beneficiary. The beneficiary should be forearmed, prior.

Some of these 'other interview results' I've been reading about here - the beneficiary was asked:

--SSN of the ex wife

--Last Income Statement of the ex wife

--Proof of Domicile on the ex wife

as the petitioner really not make a 'clean legal break' - ie - he maintained a joint account with an ex, or somehow she has a utility bill in her name at HIS address...

I'm truly sorry you she got tagged with 'not-a-bonafide-relationship'.

What are my options now?

Re-submit a brand new I-130? What would happen then?

Or wait for the file to be returned to USCIS, which is a painfully long process: Two years I heard, just to get a letter from them. And chances are youmoved in that two years and then all is lost.

I'm not familiar with the embassy in China, but from your list of questions, it's not obvious to me why she was denied. Getting the trip dates wrong isn't something that I personally would find suspicious. Nervousness isn't an indication of fraud either; someone desperately anxious to be with her husband could also be nervous and twitchy. Are you sure you've considered every angle here?

I side with you as well. I re-read the questions he posted and they barely asked any question about your ex-wife.

I brought the question about the age... is it an issue with China? I am not sure. Is there quite a bit of an age difference between you two...more than 10-15 years?

Well, also, if you never returned after the marriage, ummm........ well..... I'd think that's a red flag too, especially after seeing you make a 6 figure income. I know I'd be like, "if he has the finances to travel, why he hasn't visited after they got married?"

Not to mention the age difference. If the VO brought it up, s/he must've had issues with that too. Again, I find it hard to comprehend how anyone would go unprepared to such important event, but it sounds like you learned your lesson. Please be with her at the next interview.

Don't ever do anything you're not willing to explain the paramedics.

I noticed the real tricky question: has he visited you after the marriage? answer: no.

Then the age difference came into question.

If China is a high fraud country, as some VJers stated, then this would raise huge red flags.

Don't ever do anything you're not willing to explain the paramedics.

I am so sorry to hear abour your girl visa denial,I feel your pain.but going to the interview unprepared is like going to a war with no guns.I remember when I was interviewd by co in manila co asked me bunches of question about my fiance,s ex wife,I studied all the information about here so it was ended good,even if co squeez her so bad if she knows all those info she would be able to answer em right...

The co have the right to ask whatever questions she feels to ask,hope next time she will be more prepared.good luck and find a lawyer with the bad #### to help ya,god is be with you.
