Palladin, at this point - I recommend a consulatation with Marc Ellis.

The days of 'keeping the casefile at GUZ IV' after a 221g for not-a-bonafide-relationship are long gone, alas; almost 2 years now - this has been impossible.

Man, that really stinks. My finace has K-1 visa interview in December. They better not treat her that way. I have heard that many of these embassies that ask questions can go far overboard. I am not familiar with CR-1 process, but must be similar. I hope you can fight and get another interview date. I am angry for you now!!! Sounds like a really bad rap. You won't be on Visajourney.com if you weren't serious about this. Idiots.

Is it possible this is what concerned the interviewer more than the history of your ex-wife? Just how wrong did she get the details of your last visits?

Immigration history of ex-wife should not be an issued. I did petition for Ex, in 1994, and she came over in 1999. That's long time gone.

My wife was nervous and may have slipped her lips unconsciously. I made to trips to meet her. One for two weeks and the second one for one week just to get married. She answered one week and 10 days. Both wrong. She is that careless. But for most people unless you wrote the event down on paper, you are just likely confused whether an evern a year ago was for one week or two weeks.

That should not be a reason for suspicion. It's perfect normal for people to not remember all details of historic event, unless the VO suspected that the event never happened, which he never doubted. If it is a real sham marriage they would have coached everything that all the details are recited to the precision of minues without error.

Does it count as not knowing your spouse enough, when you are simply not paying enough attention to physical events happened, regardless of your relationship? If you don't remember whether Nov. 21, 2010 was a raininy day or not, does it mean you really don't know about your husband? There is no logical connection here!

This is only a guess, but I'm betting that between the fact that you've petitioned and divorced and that your wife seems fuzzy on the details of your relationship, the VO became skeptical (and rightfully so). The interview is your time to PROVE your case! I remember the exact dates, what we did and could probably pinpoint the weather down to the hour of the precious time I've had to visit with my fiance...

I hope you get to re-do your interview and I hope you'll prepare better!

i am sorry for you because this seems very unfair. I concur with the comments about getting a lawyer and fighting it out with them.

The CO's doing the interview can ask any questions they like. For Pui's interview they asked a lot of questions about her ex-boyfriend and why she went to England on a tourist visa before she knew me. She never overstayed her visa to England. I have also read on VJ where there has been a second interview and they wanted the petitioner there as well and gave them a stokes interview but I only read about that once or twice. Just be prepared that they can anything about the petitioner OR the beneficiary.

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

What fraud?

I am not a welfare receiver willing to get paid to sleep with a girl for two years to get her a green card.

For crying out loud I have six figure income and just want to have a normal family. The last thing I want is be used by some one to get a green card. There is true love between me and my wife. If I had scrutinized our relationship plenty of times over a year to make sure there is no marriage fraud, what do they have to say in 10 minutes of quiz!

Those VOs are a bunch of idiots! They want to detect fraud, fine. But at least they need to give honest people a chance to clarify things and remedy whatever they suspected during interview. It's unfair to outright denial and then send the files back to USCIS to sit in the dust for two years, without giving people even a chance for rebuttal.

What happens to Administrative Review by senior officer which is supposed to be done on every denial cases?

China is an immigration fraud country. Just like India, Pakistan or the MENA countries. It is what it is.

I am not the C.O. don't vent at me. We are all trying to help you. You said that you assumed since you front loaded the application that you would be fine. Break down the word assume- A$ U Me. Don't take anything for granted in the immigration process! Darnell and Pushbrk time and time again state how tough of a consulate GUZ is. You rolled the dice and sent your wife in there blindly. These people ask anything. You have a past divorce with a person from China that has gone thru this immigration process and has recived their green card. This is a red flag. Nothing against you on this but you have to face the harsh realities that this red X is on your record.

Having a good source of income in irrelevant for this as you have a red flag already. You should have talked to your wife about this. Your wife might not care for the details of your ex-wife but for the immigration interview she should have known a good amount about her.

I wish you all the luck in getting all this sorted out and get the visa for your wife. As others have suggested, it's time to get a lawyers help on this matter. Best of luck to you. I'm hoping and praying for a quick turn around for you! :)
