IR5- Original Marriage Certificate of Petitioner

Hi ,

Can someone please guide, I'm the petitioner and filed I-130 for my mother(IR-5), the case is at NVC where I'm about to submitt DS-230 with all the supporting documents. I have the photocopy of my marriage certificate but not original , the reason is I submit the original to USCIS long ago with I-90 to replace my permanent Resident card, also file a petition for the return of original document but its being one year and have'nt got the original back. now I dont know what to do, can someone please guide , any suggession.

Where did you get married?? if in the US just request a copy of the original from you Register Office!! Simple :thumbs:

Try to get a certified copy of your marriage certificate from the Pakistani government agency in charge of maintaining marriage records. This is the best option.

If you can't get a certified copy, then submit a letter with your parents' applications stating that the original was submitted to USCIS. Also, state that you have requested it be return but you have not received a reply for a year. Include any case number that you have. This should be your last option since you might get a RFE.

This is something I do not understand. I am petitioning my Mother on an IR-5. What does my marital status have to do with my Mother immigrating to the states? I just sent the IV packet in WITHOUT my marriage certificate. My mother's was included as was my Fathers death certificate.

I understand the need for any IR-1/CR-1 to have this but what the IR-5?

I have my documents on standby and ready to go if need be.

Bad....You will possibly get a RFE whatever they request you should send it..Why to question them at this time of the process? If they ask you for a BANANA!! Just send the freaking BANANA!They just want to make sure that everything in your life is legit!You are a USC today but you got to this stage marrying somebody long time ago and they to check back on you!

Understood. If the RFE comes, I'm ready with documents and cover letter loaded in an express mail envelope.

Bad decision on my hubby's part. Oh well, we have never had an RFE before...this may be our first.
