Please help me

I entered the US on a travel visa on 18th July and learnt that I was pregnant so married my husband so we could stay together and prepare for the baby.

we filed the following applications on 19th August 2011 -

I131 approved 26th october 2011,

I765 approved 1st November 2011 (did previously say 26th October but was changed on the 1st november)

I130 Initial Review

I485 Initial Review

We booked non refundable flights back to England on the 6th November - The reason I initially wnated to travel was my grannies 80th birthday and I had my final exam in personal training on the 8th in London.

Since being hear and learning I was pregnant we have had to pay for all medical. Im on my husbands medical insurance but cant claim until I have a social security number. My husband recently took a huge page cut and we cant afford the medical bills anymore. My Dr wrote me a letter advising that I be sent home for the treatment I require.

I took this into the Orlando office on the 25th october same day as having my bio metrics done. I asked for my I131 to be expedited. The officer opened up a case. The next day I checke don line and it said my application had been approved and notice would be mailed out. I didnt hear anything back from the expedite. I have called the uscis office several times who cant tell me what happened to the expedite but that its been approved so have to wait on the mail. They couldnt tell me how long it takes but then apparently with the letter I have to go and get a card. I called again yesterday and explained I have non refundable flights I need to travel due to my medical condition they opened another case. Went to the orlando office the supervisor said Im in a bad position as im waiting on the mail and they cant issue me my expedition request there so I can travel as that would be illegal to issue two. My point was what if it never arrives in the mail or not in time can I have it shipped to me so i can re enter and what do I do once I receive notice in the mail do i have to get a card. Iv been to the office three times now each officer says something different each phone person again three says something different. Im totally in limbo and confused of what to do someone please HELP

It is not advised to leave without the AP card.

If you have someone watching your mail to forward the card to you and something happens to the AP card and you never get it you are screwed!

OP, you can see what a real nightmare the bureaucratic process can be with you here in the country, and having the ablitity to walk into a local office and get different tales.

It would not be wise to leave the country without AP/GC, dealing with this from across the pond would mean an additional headache.

Do you really want to risk a hiccup happening and you not being able to get back in the country?

I would be as concerned about qualifying for free NHS treatment WITH a foreign resident card as I would about getting the Advance Parole to leave the US. Once the UK regards you as a non-resident, you are obliged to reside for four months in the UK before you requalify for the UK benefits system. I would certainly ask someone from home to check your position with the local health authority, or you could have a nasty surprise on arriving back in England.

What visa did you enter the U.S. with and when does you I-94 expire?

I an asking this because you may not want to leave the U.S. even with AP at hand.

I came on just a regular 90 day tourist visa I was coming for a vacation to visit my fiancee. But then when we learned I was pregnant we got married I stade and we filed the application.

I called the uscis again today they say i have to wait 30 days to get the document if it doesnt arrive in 30 days then I wait 15 for them to send me another one so could be a totaL OF 45 days and my flight is booked friday and drs appointment monday in england.

What happens to people who take the document with them the i131 and loose it there anyway are they stuck forever? Because luggage etc does go missing sometimes.

There is no such thing as a 90-day tourist visa. The tourist visa (visitor's visa) is a B2 and it pre-authorizes a stay up to 6 months.

My wild guess is that you came as part of the VWP. That means you do not have a visa. No visa. No. Nada. Nilch. Is there an actual visa in your passport?

However, since you filed on August 19, you entered a period of authorized stay in the U.S. It is not quite a status, but you are not out of status either. But if you leave without AP at hand, you are effectively abandon your AoS petition.
