well, my wife is the petitioner, she is a US Citizen and has some illness that its medecines and the hospitalisations are expensive and she is already under her mom's insurance.

my question is :

the fact that we got married in september 2011 means that she is not considered under her mom's insurance anymore because she is my wife right now ?

or she will still be considered single and she can stay under her mom's insurance till the USCIS will approve the bonafit of our application (the bonafit of the marriage) ? ... she filed for me the form I-130 for the CR1

OR

she is considered married eventhough the USCIS didn't approve our marriage yet ?

if so, then she can not pay her current debt of her meds which is more than 20 000,00 $ !!!

so, what can she do now ? because she is still student and she is 23 years old, and she doesn't work for now since 2 months

MY IMPORTANT QUESTION IS : when exactly the government will change her health insurance from her mom's one to mine ? exactly when we get married or when the uscis will approve our application ? because her mom told her that she has to be sure if her mom still can use her health insurance to support her daugther or not.

please any suggestion will help me and thanks guys for all your help.

She would only be covered under her Mom's insurance if she was single and up to the age of 26. Why did you'll get married if you'll wasn't ready to accept grown-up responsibilities.

To answer the other part of your question, married is married regardless where you were married at. All of this should have been discussed before the I do's.

ohhh !!! sorry i mean: her dad's insurance not her mom's one

so, does she can use her dad's one untill she finish her school this year and start to work ?

or she can't use it for the fact we got married ? even though i live in in Quatar right now for work far than her... what can she do ?

It's not my place to tell her or her Dad to lie about her marital status. If he lies and his insurance policy company finds out, he will have to deal with the consequencies.

USCIS doesn't approve marriages. She has been legally married from the moment you said I do's, NOT when USCIS approves your I-130.

Do not lie on any insurance paperwork. That would be considered fraud.

On the bright side, there are a lot of folks in the US that have more than $20k in medical debts. Ultimately the medical provider will try to collect. After they can't, they will sell or assign the debt to a collection agency. It may or may not show up on her credit report. They may or may not file suit. It they don't ever file suit and it never shows up on her credit report then it's really not that big of a deal. You are worrying over nothing at this point. Millions of Americans have the same issue. I don't advocate not paying a bill, but it's not like it is going to destroy her life at this point.

Insurance fraud on the other hand isn't something to play with.

Like some other people said here, if she's under her parents' insurance, she will be covered until the age of 26. My husband I got married last july. He was under his mom's insurance and he was in her plan until he turned 26 this september. Now, we have our own insurance.

You are officially married however the process isn't finished as of yet. She can ride out the rest of the policy until it's time to renew. which is just about that time. I suggest that she file for disability and or medicaid to cover her health issues. But do it quickly. Takes about 30 working days for medicaid and up to a year for SSI disability... could go faster depending on your state. We all need health insurance and there are some agencies that will provide charity, free medications or sliding scale fee's based on income (including meds) so that she may continue to get good heath care. I have been where you guys are. I work in the medical field so I know that certain services are available to thoes who seek them out. Work fast and God bless you and keep you coverd.

I think you have the answers from all teh comments above - legally your wife can continue to be covered under her mother's policy whetehr she is marrid or single until age 26.

Your mother-in-law can check with her insurance company to provide peace of mind for herself. Your wife can choose to drop off her mother's and join yours if your plan allows that (I assume you're in the US and have your own insurance through an employer or something like that?) Since you didn't add her through a 'life event' like marriage, your insurance company may have a rule that you have to wait to add her during an 'Open Enrollment' period. You should check yourself

Not correct - please ensure you're aware of current laws before giving advice - milimelo's link above is correct.

I would not say Mili's link is correct either... best option is ask her dad or mom whoever is the primary on the health insurance to contact the insurance company and discuss the situation and they can let you know what are the best and possible options available.

And to be precise yes you are married as lot of ppl said on here USCIS does not make that call, you are married and only based on that your application is in the system.
