We got a letter saying we have to go for an interview June,26. It says (among others things) to bring VALID UNEXPIRED PASSPORT. The problem is my Russian passport is expired. I only need it to travel to Russia and i wasn't planning on doing it for a while. It costs a lot of money to renew it. I wasn't planning on doing it in the near future...What do i do now..

Exactly why do you want to argue with the USCIS? Do what they ask and count your blessings.

We received the "transferring your case to local office for interview" letter on about May 25. We then received the interview appointment letter on June 12, with the scheduled interview date July 11th.

SiberianInSoCal, I'm sorry to hear about your latest predicament. This has definitely been a much more complicated and stressful process than I had anticipated, and it sounds like you're in the same boat. Did you try searching for "i751 passport"? I did and found the following:

It's not exactly authoritative (not much is on VJ), but they did raise a good point: that a valid (unexpired) passport will be required for international travel (which itself is not even authoritative, as you may be able to get an enhanced state ID for Mexico/Canada travel). From this perspective, at least to me, it would make sense to eventually get your passport renewed.

As far as your I751 interview, I can think of at least three options:

1) Do as MikeInWyoming says: reschedule your interview, contact your consulate to renew your passport in the meantime.

2) Go to the interview and hope they don't notice. Don't show them your passport unless they ask. Use your green card and extension letter as ID. There's a chance you won't even get in the door this way, but it's an option you can try.

2a) If you don't get in the door, maybe you can call that same day to reschedule.

2b) Or you may get in, but they extend their decision pending your acquisition of a valid passport.

2c) In the door or not, you may get I751 declined, then you can appeal.

Mike & Sachie, thank you so much! still waiting what my lawyer has to say about it. I asked him about 2 months ago if i can go to an interview with an expired passport. He said,"yes and it s not a problem at all" I think the only reason they need my passport is to stamp it because they will take my 2 year expired card. So i suppose they will stamp my passport while i'm waiting for my 10 year card (if i get approved)

Mike&Sachie, when you went to the interview, did they check your passport? what did they do with it? and what did security guard check on the door to let you in? I mean i was told to bring my expirec gc, passport and DL or ID.

It's funny how they don't need your passport to file I-751 and everyone says you don't need it. And then out of a sudden they need it for an interview There is no clear instructions!!!

You are correct the process is not clear and sometimes it can be aggravating... however the assumption that your passport should be current when in another country is not a stretch of understanding. It is 'assumed.' That may not be agreeable to you but it has always been something that I have understood and I suspect that, while it is not in the 751 instructions, there is in more basic info about being in the USA, a requirement that your passport be valid.

You are going to spend how much money, stress, time and worry to 'argue' with a Government process? It will likely cost you more than doing what they ask. It will add stress top your life you don't need and then there is the risk... The risk is you lose... not just once and then win on appeal, but lose completely. Granted the likelihood of that is small, but the heartache, time and treasure you will spend fighting what could have been a fairly easy if delayed process, is a poor choice.

'Playing chicken' with Government is not something you should choose to do unless you have no choice. Governments can and will be arbitrary and frustrating. That's just life. Swallow your pride, accept the fact that your lawyer is wrong and get the damned thing done and over with.

thank you for looking out for me. I am waiting till Monday to see what my lawyer has to say. I did a little research on my own. I will also call them on Monday and see what they have to say. Rescheduling isn't an option unless they tell me otherwise. It might take me like 4+ months to get a new passport.And meanwhile they can schedule me for an interview again and then i will have to reschedule again. That's what happened to me when i was trying to get my first green card. My husband was overseas on a goverment job. we provided the letter saying where he was and for how long, but they just kept sending me appointments for an interview until one day i got a letter saying that i have to come by myself and i found out ONE day before the interview. It wasn't nice at all. So we shall see. I also called another lawyer and he also said that it is not a big deal and i should concentrate on the interview itself instead of this.

oh i see! i asked you and then i saw that your interview is not until July.

It means we will go first. My lawyer won't be able to come with us actually.He is advising to reschedule so he can be there and he can even do that in person. He says it will postpone it by days or weeks, not months. I am thinking to go without him,but then i remember last time it was very nice to have him by my side because the officer wasn't nice at all. He kept accusing my nation of God knows what, until my lawyer interfered and asked him what it had to do with me!He immediately apologized and finished the interview in a very friendly manner.
