Forget to say I sent it to Vermont center.

How come I didn't get the confirmation letter (NOA1?) ?

I mailed the package on 11/13/2011. The 1st letter they sent to me, the only letter I got so far, was the finger print appointment. I did it in Dec2011.

Also I checked online, my case was under initial review and they said they received my case on 11/28/2011.

So they do filed my case. My problem is I can't go aboard without Noa1.

What can I do now?

Well I ended up re-sending a copy of my tax transcript in whole for 2010, as well as a copy of my return for 2011, along with copies of all the W2s for both of those years. I originally only submitted I believe a single page of the 2010 transcript and no W2s (along with other supporting evidence).

I'm not sure what got into me that made me think that 1 page of a transcript would be fine for taxes supporting evidence - but I think it was due to the fact that I had successfully submitted every form without issue through the I-130 journey, and had led myself to believe that because Japan is a low-fraud country, that the ROC would basically just be a matter of rubber stamping the petition. Upon further reflection, there was also a pretty substantial increase in our 2010 joint return's gross income that resulted from me working full time throughout 2010, and combined with wife's income, it could look funny to see the big jump from the previous tax returns/estimates I submitted as part of the I-130. Without W2s, it's impossible to tell where that income is coming from, and I think that could introduce reasonable doubt into an adjudicator's mind.

Regarding AOS, within the context of an I-130 petition it means "Affidavit of Support" and not "Adjustment of Status." It has nothing to do with the beginning of residency. For someone who entered the country after having an I-130 petition approved & visa granted, USCIS should be looking at POE (point of entry) date as the beginning of residency, and not AOS (affidavit of support) filing date, which happens when they are still out of country.

The RoC assumes two years of residency. It is up to Mike and Sachie to explain why that does not exist.

For the I-130 filers, there is no existing residency of any sort prior to the date they enter the country, which is the beginning of their legal permanent residency, and they are allowed/required to file ROC 90 days short of two years from that entry date. As such, at the time of ROC filing it impossible to provide proof of two years of residency, and I don't think it's reasonable to expect that any I-130 petitioner would need to explain why that is.

Still waiting here!! Sent package end of November and had biometrics in January. Still waiting. Is this normal? Should I be worried?

No, this is the current normal for VSC. They're way behind CSC and have been for getting on a year now.
