Wow! This thread is very informative (and also funny! :lol: - i.e. NANAY vs. NANNY ) My husband & I am also expecting our first child and we're planning to invite my mother here to VISIT us for a short period of time when I give birth. I do hope that my mother will not encounter any problems during the application process and will get her visa approved (crossing my fingers & toes! :P ). Wish us luck! ;)

There is absolutely no way for you to bring a foreign citizen to the US to be your nanny.

First, a visitor visa holder cannot work in the US. Being a nanny is work. It doesn't matter if the nanny is working for free.

Second, a US employer who wishes to bring a foreign person over for a job must file a Dept. of Labor certification that no US resident is available or qualify for the job. This will be impossible for you to do as there are lots of people here who qualify to do the job.

Third, US employment laws would apply. You cannot pay the nanny based on the prevailing rate in the Philippines. You would need to pay US wages. Lots of people who have brought "help" with them from outside the US to work in the US have run afoul of paying less than minimum wage.

Not NANNY! Nanay its a term meaning mother.

What does OP mean? I am trying to have my mom apply for a tourist visa and be with us while her petition is in process. She does not have any job but I will support her expenses while she's here. Is it necessary for me then to provide affidavit of support?

While her petition is being processed?   You have an I-130 petition is process?         Odds of getting a tourist visa are slim .. with a petition currently at USCIS .. even slimmer

 

Tourist visas are issued on the merit of the applicant only  ... you can provide nothing that would add to her chances of being approved for a tourist visa.
