Hi, I am new to the forum I tried researching but I could not find any info. I am in the process of doing my K-1 Package for my Fiance in Mexico, I am 23 years old and she is 19. Currently I don't have any way to prove my wages since for the past year 1/2 I've been unemployed I've been coming back and forth between Mexico to be with my fiance. My question would be since I can't prove my income can my dad be the sponsor? can he fill out the I-134? His income is around $55,000 yearly. Or should I file a 1099 to be able to prove wages? I appreciate your help.

I'm confused. Did you work at all during the last yeara nd a half? If so, did you receive a W-2? Did you file taxes?

You can not file a 1099. A 1099 is issued to you if you were an independent contractor who received income without taxes being withheld.

To answer your question tho, yes, your dad can be the sponsor.

The dad can be the sponsor IF he is a USC and earns enough to prove over 125% poverty guidelines for his household size + the fiance.

The petitioner still needs to fill out a I-134 and produce tax returns if he was required to file one.

Technically I don't work but for the past year I've been receiving $1000.00 for my time, and it gets deposited to my bank account. My dads household is him and my mom. This lady technically pays me that money so I can talk to her over the phone and I make myself available to her 24 hours a day so I don't consider it a job I just listen to her. It sounds odd but its the truth.

That is not a job. In order for it to be a job, you have to have Federal Taxes taken out or be paying quarterly taxes but you have to pay taxes. They would not view this favorably and it might dig you in a deep whole if you claim it as earned income. :bonk:

Read my post #4 for qualifiers for him to be a co-sponsor. If he qualifies with what I listed he can be a co-sponsor.

BUT - if you need to file a federal return, better do that because YOU also need to file I-134.

Your dad can be the co-sponsor. You still need to fill out the I-134, and he will fill out his own I-134. If you were required to file taxes for 2010, then file them now. If you were not required (did not make enough), then provide a statement as to why you did not legally have to file taxes. Your dad will need to provide tax transcripts from the IRS (or a full copy of his returns, including W-2s), letter of employment a few months worth of the latest pay stubs before the interview, and proof of being a USC or LPR.

These things are needed for the visa interview stage, and are not sent in with the I-129F petition. You have time to plan and gather the documents together before then.

Haha, no it's not. This lady has no one to talk too so she expects me to be available to her 24 hours a day, sometimes she calls me at 2 in the morning or when ever she feels like it and I just need to listen to her problems and try to give her advice.
