Mom passed interview YAY.... you would think

Hello everyone,

My husband and I have been skating through the I-130 process for his mother, which has been smooth for the most part. She went to her medical 8 days prior to her interview (the paperwork says go one week before) and her interview went awesome until.............

They said that her medical paperwork hadn't been received, but that as soon as they have it, she can come back and get the visa put in her passport. So.... we called Dr. Khadija, and got her "customer service representative" (for the sake of being OVERLY polite) who first said they wait ten days to send everyone's paperwork (odd since the letter from the US gov't says u need only a week.)

Now, 12 days after her interview, we call the Dr. back again, get the same sweet receptionist, who tells us that she needs a copy of the prescription the doctor gave to our mother (which she managed to do on a second visit so that she could charge an extra fee "just how they do it") before she can send the file. We had our brother go today with the paperwork that she requested (by the way the prescription ended up making our mother violently ill- and was for an infection that she didn't actually have) and the receptionist acted like she "would see' whether or not they would send the papers tomorrow.

Has anyone else had the same problem with this doctor?? Does anyone know who to contact to file a complaint against her?

Timeline

You can file a complaint with the US consulate where your mother went for her interview. If they receive enough complaints, and they confirm them to be legitimate, then they may disqualify her as a panel physician and select another doctor.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

So far, I have contacted my Senators. I have not had much luck with contacting the consulate, however my husband was able to get through to the doctor after threatening the receptionist to sue them. The doctor was very nice to my husband on the phone, and told him the consulate had called asking where the file was-

This is the same doctor he used when he went through the process. He thinks the real problem is the assistant and not the doctor- I don't know though. I'm pretty peaved about her making mom sick.

At this point, she swore she'd have the file sent yesterday by 5:50 pm and it would be at the consulate within a couple days.

We'll see............

Other than an inquiry, there's not much a Senator could do. US consulates are part of the Department of State, which is an Executive Branch agency. They answer to the Secretary of State, who answers to the President. Consulates are required by law to respond to inquiries from Senators and Congressmen, but they don't take orders from them.

Consulates have a process for approving local doctors to serve as panel physicians for immigration medicals. The consulate's biggest concern would be a panel physician who is either approving applicants who should be medically disqualified, or denying applicants who should be medically qualified. The consulate doesn't place a high priority on the quality of customer service provided by the panel physician or their staff, and at some panel physicians in some countries the quality of customer service is downright horrible. Still, if the consulate receives enough complaints then they can put pressure on the panel physician to improve their service or lose their certification as a panel physician.
