I have a little dilema my has to send in her income tax papers for AOS well she filed for my little cousin son who obviously has the same last name as me, we don't have kids together but I was wondering would that be a red flag or they don't even pay attention to that just how much she is making. How could I go around this issue?

Are you saying she claimed him as a dependent, and is he actually a dependent or not. If he is, no big deal--if he isn't she better refile before she sends in any I-864 paperwork. You don't want the IRS after you for any reason.

Well, it is not an IRS problem, but since he is on her tax return as an dependent then he must be counted on the I-864 as a dependent which raises the minimum income level that she will have to attain.

NVC will not care about who she has sponsored before you, as long as she meets the minimum income requirements to sponsor you on top of any dependents and your cousin's son.

The embassy may have questions regarding the cousin son's relation to you and why she sponsored them before sponsoring her spouse. :unsure:

She MUST list the cousin son on the I-864 where is asks about others she has sponsored.

Be honest and prepared to answer questions about the other immigrant in your interview.

first had no idea she could file for me and I'm in a different country and second would I have to prove that he's my cousins child. Ja princess you seem to have brought up some good points I would love to her your input please.

There is nothing really to do :unsure:

Follow the visa process, make sure her income is enough to qualify as a sponsor for you and your cousin on top of any other dependents she has. Understand the details of her sponsoring him so that in case you are asked any questions at the interview you will be able to answer them accurately. I don't think you will have to prove he is related, I just think they may ask the connection between you/her and the previous immigrant.

Saying you did not know she could file for you sounds iffy... especially if she knew enough to sponsor someone else. :blink:

Just be honest.

No I meant that my cousin son is in the states where my wife is and because I live in jamaica I didn't know it was possible for her to file for me.And you keep refering to my cousins son as immigrant, my wife is only petitioning for me not my cousins son.

sorry, I think we are misunderstanding each other...

Your original post said she filed for your cousin's son... so that makes him an immigrant, right? (from a country other than the US)

You say she filed for him, but I think you mean she co-sponsored him as she could not have "filed" for someone who was not an immediate relative...

You now, are the intending immigrant ;)

ahhhh.... immigration lingo... :help:
