Hello Everybody,

For the I-864 Affidavit of Support, it requires the income for the last 3 years of Tax. I have been working only the last year in the U.S. so I just have my Tax return information for the last year (2010).

Do you think it will be a problem if I only send 1 year of Tax return Information? Or I need to send them an explanation?

I appreciate your feedback. Thank you.

You would need a co-sponsor to file an I-864 as well.

Only past year is mandatory, the last 3 is optional (if I recall correctly, that is what the form itself says). Most send the 3 years, and it would be best if you add a couple of lines to note why you cannot.

Thank you for your quick response. I had the concern because the form comes with a check box that says:

"I have filed a Federal tax return for each of the three most recent tax years."

And I only have it for the last year.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Are you the immigrant or the USC? USC's and LPR's are required to file every year. If you weren't required to (didn't earn enough, student etc) then you include a letter explaining why you weren't required to file for those years.

You would need a co-sponsor to file an I-864 as well.

Only if their income is insufficient would they need a co-sponsor. Not filing taxes doesn't exclude them from being a sole sponsor. If they were required to file taxes and didn't then they will need to.

Only my personal experience, but I only sent the previous year (was required to file in 2007 and 2009 but not in 2008, I only sent 2009). I didn't have any issue.

10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!
