Timeline

Hi all,

I have a questions for you.

I got married 2 weeks ago and changed my last name to my husband's.

I went to the Social Security office and changed it legally while i applied for my SSN.

I got a letter back from the Social Security Office saying that they couldn't issue me with a SSN yet because my K1 visa will run out before they issue the card (i just sent off my AOS application so there i guess i have to wait for proof that i'm on the green card track).

Anyway, my problem is that all my UK ID (driver's license and passport) says my maiden name. I want to change these to my married name but obviously my passport has my K1 visa in it... has anyone had this problem... what did you do?

2011 Jan 3rd: NOA1 - USCIS received I-129f

2011 Jan 7th: 'Touched' by VSC

2011 May 13th: NOA2!!!!

2011 May 19th: NVC received

2011 May 23rd: NVC sent file out to London Consulate

2011 May 26th: London Consulate rcvd

2011 June 8th: London Consulate sent out packet 3

2011 June 10th: Medical appointment

2011 June 11th: Received packet 3

2011 June 13th: Sent packet 3 back to Embassy

2011 June 23rd: Packet 3 approved at Embassy and logged on to system - NO RFE!

2011 July 1st: Received packet 4 by standard mail

2011 August 3rd: Interview at US Embassy London

2011 August 12th: Moved to the USA: POE Atlanta... easy peasy!

2011 October 13th: Married

2011 October 25th: Sent off AOS

2011 October 27th: AOS signed for at Government location

2011 November 1st: Email and Text notification that AOS and EAD accepted and being sent to benefits centre.

2011 November 7th: Letter from USCIS with biometrics date

2011 November 2?th: Letter from USCIS RFE on affidavit of support (insufficient evidence for proof of income)

2011 November 30th: Biometrics done

2011 December 9th: RFE in review for AOS

2011 December 15th: Notice that AOS has been sent to CSC for faster processing

2011 December 21st: Notice that AOS has reached CSC

2011 December 23rd: Notice that ead card was in production

2011 December 30th: 2nd notification that EAD was in Post Decision Activity and on it's way to me in the mail.

2012 April 5th: AOS approved, Green Card in production!

Your K1 visa was void the minute you went through POE, so it's no longer a concern. You can use a copy of you marriage license to show why you have a name difference in say your new greencard and your passport. You can continue to use your passport until it expires by having a copy of the marriage license.

There is that awkward period between the I-94 expiration and getting the greencard that all K1s go through, but it's a limbo you just have to endure.

What a load of BS, you go back and tell them or try another office that you are eligible to get your SSN and in your married name. As stated your K1 visa ran out when you got off the plane. You are married and using your husbands name you waited 2 week but you have been here longer so you are in the system and you can get an SSN in your married name. Your SS card will have :not authorised for work by DHS" but then once you get your GC you can either go and have that taken off or just leave it I chose to go and get that taken off. We hear so many stories on here about SS offices and them not knowing the law. Try another office and speak to a supervisor. I married and 3 weeks later we went in with marriage cert and my passport which was in my previous name and never had an issue. Try again k and don't give up but then some are agoing to say depends on what state you are in consensus is across the board you are entitled to a SSN other wise you can't have bank account medical and so on.

Barbara--Today is around the 80th day of her I-94, which is too late to get a SSN. Had she gone in late August, even before marriage, she would have gotten a SSN.
