hello guys! i have something to share and i hope you guys can advise me, coz i'm a little bit confused for the next step. sigh

i was married to a Dual citizen US-Filipina last march 2011. she brought me here via fiance visa. we have a 4 month old daughter born last june 2011 here in anaheim CA, USA. i already have 2yr GC (conditional) and EAD, SSN (received Green Card Sept 22, 2011). so were starting to gather information regarding removal condition for residency. i'm working temporary on a retail store. my wife is also working part time as a caregiver. but we can't afford the cost of living here. My aunt (co-sponsor) is helping us to pay our rent, utilities and sometimes for the food. so our plan is to send my wife and daughter to philippines for the mean time until i can save money. but i don't knonow if sending them back to philippines is a good idea now that we have to be together for 2 yrs to prove our marriage for ROC on sept. 2013. pls help me! thanks

1. what are the needed documents for Removal of condition?

2. do i need to notify USCIS if my wife goes back to philippines?

4/27/11 - AOS and EAD packet sent to chicago lock box

5/2/11 - package received

6/4/11 - EAD, AOS receipt and ASC Biometrics appointment letter arrived.

6/29/11 - Biometrics done

7/1/11 - RFE issued

7/15/11 - RFE response received by DHS

9/12/11 - interview day!! whew

9/16/11 - received email notification that we passed AOS interview

9/22/11 received Green card! yess

2 years of proof of living together and co-mingling your lives. If you send her back you will likely not be approved for ROC. Filing ROC is a joint petition done by the married couple. Unless you are divorced then you file with waiver.

you need to gather information for the last two years show proof that your a bondafide married couple living togather,same address every thing jointy.proof that your a loving couple,file taxes jointy,both drivers showing same address,joint banking, jointinsurance,family plan cell phones,rent, or lease,joint utilitys,pictures family different times places,junk mail both names,any trips togather with your names boarding passes,get two friends to write affidavits that your a loving married couple, good luck to you what ever you decide,

California is expensive. Any chance you could move to a more affordable location? Compare the cost of living where you are with Idaho or Wyoming, for example.

As far as forms, look at the Guides on the menu above. Look for "removal of conditions".

I think the main issue wont be the ROC as much as the stay in the US to keep the LPR condition.. If she's gone for 2 years, I think she might lose the LPR status

If I read the OP correctly the wife is the US Citizen Petitioner?

It is confusing though as a lot of Filipinos aren't used to gender specific pronouns (for example my wife often calls her brother's infant son her niece).

RonRon can you confirm you are talking about the US Petitioner returning to the Philippines for a couple of years?

Regardless I would think it will make proving bonefide marriage difficult at best of you live in 2 different countries after the Alien spouse moves to the US especially if the Alien spouse's relative was a co-sponsor.
