Hi guys,

My Mum is an EU citizen and she lives in the US for about two years now. Basically she has travelled to the US to work and then she decided to stay without getting a work permit or Visa. So far, she was lucky and everything went ok. However, her age doesn’t allow her to work nor stay in the US anymore on her own so now she is thinking to come back home.

We are just a bit worried about what could happen if she just buys a ticket and goes to airport to come back home? Will she get arrested or get fine for staying longer that six months without having a Visa? Will she be alright or she gets deported? If she gets deported will she be able to travel to any other EU countries?

We will be very thankful if someone could answer these questions or advice

She will probably get a 10 year ban and not be able to come back to the U.S. for that period of time. Shouldn't have any effect on her status in Europe if she is a citizen there.

They will not harass her in any way when she leaves. They don't arrest people leaving the US unless they're wanted for a crime, and overstaying a visa is not a crime. She can't be sentenced to jail for it. The only thing they could do to her is deport her, and they wont do that if she's leaving voluntarily.

She'll incur a 10 year ban for overstaying for more than a year. The ban kicks in when she leaves the US. If she's got a visitors visa then it will be cancelled, and she won't be able to apply for another visa to the US for ten years.

Immigration violations in the US have no effect on an alien's ability to travel anywhere else in the world. She'll still be able to travel throughout the EU, just as she could before.
