Timeline

My fiance has decided not to marry and remain single in the Philippines

I just filed for K-1 in September just over a month now since NOA1

My check has not been cashed yet (not that it's the most important thing)

My question is this

If I call Vermont Service Center and request the K-1 Visa be canceled will it count against me in the future?

If I were to apply for another K-1 Visa in the future would I answer yes to the question have I ever applied before?

Keep in mind my package has not been touched only forwarded to Vermont so far NOA1 only

!

Any advice to my sad situation is GREATLY appreciated

NOA1 was a receipt. The check has been cashed.

no don't cancel the check i did that and uscis still demands the payment even if the petition is voided. they will send you a bill with interests..

Nonsense. If the check bounces they reject the petition. They do not demand payment, and they do not charge interest.

"CONGRATULATIONS" for finding out on THIS END versus later on after the process would be further down the road. There is something to be said about the long visa process that permits time, hopefully, for the truth to come out. Otherwise, we'd be having "Las Vegas Weddings", online, if we could, with our foreign significant others!

To all I went back and checked my electronic bank statement and you all are correct!

I was looking at the check numbers and it was not listed so I assumed it had not been cashed

But after reading these many replies I went back and it is scanned as debit and is not listed as my check number

So sorry for the confusion

Also my fiancé came here on Visa Journey and read my post and has asked for forgiveness.

I know how hard this process can be and we both have so much time and effort invested I do not want to give up on this relationship.

I will also say no other man is involved and I have no reason to suspect it.

It all comes down to money and the lack of it immune Philippines.

I think we have this issue resolved

Now we wait for Feb for NOA2

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

Lack of money In the Philippines it should read

I don't want to derail anything but in all honesty her getting engaged didn't change or affect her & her family's financial situation in the Philippines.

You might want to review exactly what happened and evaluate it not as someone in the heat of the relationship but as an unbiased 3rd party observer.

My Awesome Pinay Wife's financial expectations have never changed, she still expects herself to work just as hard to support our family as I do.

A few members of her family had these sudden changes in expectations but she was always the stopping point for any of it. She loves her Mom & brother but they were both making it before she married me and she should be able to continue to do so even now that she's in America. Of course that doesn't mean we don't do anything for them but it's always at our choosing.

I'm ready for her Mom to move here in 2 or 3 years and expect that we'll become her sole source of support as she'll probably not be able to work once here but that's a situation we're both okay with.

Ok - there is some misinformation in this thread concerning the waiver.

Only if his petition was approved in the previous 2 years (from the date of the new filing), would he need a waiver. Since he only has the NOA1 - it was not approved, therefore, he would not need it in this case.

The other waiver needed is if he, at anytime in the past, filed 2 or more petitions. Since this is his 1st petition*, if he files another one, he would not need a waiver, since he only filed one in the past. If he files one more for some reason, then he would need a waiver.

Source - I-129F instructions, item 2.

(*this is assuming he only filed this one petition as of today)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Many of the people we as VJ'ers fall in love with are from poverty stricken countries and somehow, they managed to survive before we entered their lives.

For your fiance to do an about face regarding her financial situation only a month into the K-1 process is a loud and clear warning. I am not saying she is not what she appears to be, but I'd tread very carefully and have a detailed conversation with her BEFORE she comes to the US as to what the financial arrangements will be. It is better to have this conversation now than once you are married - so there will not be unrealistic expectations later down the road.

Use this time to get things clearly stated and you will be better off for it.

I asked the really hard questions of my fiance early on (within the first 2 weeks). I wanted our relationship to either fall apart in the early stages or grow stronger. As it turns out, all of these questions in our relationship were answered and we only reinforce them in our discussions. It really made it easy for us. We are sailing through and have bonded much more since I have returned to America.

Marriage is a very, very serious step. Get all the input you can. I haven't read any of these books but I might. I just think I covered most all the important questions already but if you haven't, assemble some questions and you might get some from here.

The true goal is for both of you to be happy.. that is the only way.
