My fiance has decided not to marry and remain single in the Philippines

I just filed for K-1 in September just over a month now since NOA1

My check has not been cashed yet (not that it's the most important thing)

My question is this

If I call Vermont Service Center and request the K-1 Visa be canceled will it count against me in the future?

If I were to apply for another K-1 Visa in the future would I answer yes to the question have I ever applied before?

Keep in mind my package has not been touched only forwarded to Vermont so far NOA1 only

!

Any advice to my sad situation is GREATLY appreciated

If I were to apply for another K-1 Visa in the future would I answer yes to the question have I ever applied before? You answer "yes" because you've have applied by sending in the current K-1.

Keep in mind my package has not been touched only forwarded to Vermont so far NOA1 only

You can send a registered letter, referencing your case number and ask that the petition be withdrawn.

It certainly is a sad situation for you, but look at it this way... it is better to be aware of this now rather than later.

In addition to the registered letter withdrawning the petition, I personally would cancel the check (stop payment) on

the very same day I have a receipt as proof of sending the letter.

Honesty will always remain the best policy. Straightforward and simple, I think. And, then you ad a paper of explanation. They aren't going to hold it against you, unless SOME DETAILED EXPLANATION turns up some Weird Stuff.

07/27/2011...........NOA1 received.

12/05/2011...........RFE received.

12/13/2011...........RFE response sent.

12/16/2011...........RFE RESPONSE received by Vermont S.C.

12/22/2011...........Teased by a text-message from uscis, saying they have received my response to the RFE.

12/30/2011...........LA VISA APROVADOOOOOOOOO!!!!!!!!!!!

01/12/2012...........Case Sent To Bogota Colombia, from the National Visa Center.

02/09/2012...........Schedule Interview.

03/23/2012...........Interview (to take place then)!

04/07/2012...........Arrived in USA.

07/01/2012...........MARRIED!

What next?

.......How the days DO slip away!

I doubt you will get your check back. You can try, as another suggested, of calling your bank and canceling the check. don't know if they will ask you to resubmit, but worth a try.

Nothing wierd just a money grubbing thing it looks like

But I will do a registered letter

I guess being slow on processing worked in my favor this time

I realy thought I had all the bases covered.

Chatted twice a day from Feb till Sept

emailed and snail mailed

We both had a GREAT time together in Cebu

Money never seemed to be an issue until I returned home

Anyway thanks for the advice

If your future fiancee is another foreigner, she may have a difficulty as they sometimes call this a red flag if 2 petitions are done within the span of 2 yrs. You may even need a waiver if you are going to refile for the same person. But as been said, just tell them the truth.

As mentioned before, you'll need a waiver if you petition again within 2 years. You should not have a problem in the future, many have successfully petitioned a second time.

i have had this happen to me for my first petition. it will not count agianst you in the future, but you can kiss the payment goodbye, they keep it. but you should send a letter to the place that has the petition and tell them to discontinue and make a copy of your noa1 and send it with your letter. don't worry about answering yes to the quest. have you applied before. if anything you will be sent a waiver in the next petition and then just send the cancelation letter again. just have extra copies of everything. so you can prove your point. take care/good luck. dan

no don't cancel the check i did that and uscis still demands the payment even if the petition is voided. they will send you a bill with interests..

My NOA1 says to call the customer service number provided regarding questions or status or changes?

Will I get my check back?

I just had this happen to a friend of mine too. Seems to happen often happened to me too. Anyhow you will need to send a certified copy of a letter stating please with draw my petition for CASE #. Include your name and address and birth date he name and address and birth date. Send one to each NVC USCIS and the MANILA EMBASSY.. Keep copies of the certified return receipts you will need those along with the cancellation letters copies of course to each agency. This way when you do file another petition you will have supporting evidence. Also they do not have to withdraw any petition. You will not need any waiver I withdrew 2 petitions and filed a 3rd (switched countries). Both previous were the Philippines.
