Timeline

came in on k1 visa and got married on august 19 , i already applied for ssn and started some CNa class but havent started working coz they need EAD but since my husband is a lil broke right n ow paying off the credit cards used for my fare and other stuff just for me to get here, i dont think we can file AOS till next three weeks for we need to save up a lil to pay 1010 dollars for the AOS , will i be ok becasue my I-194 will expire on november 2 ....PS we already gathered our papers just havent sent it coz we dont have enough money to pay for it yet ....

We are in the same situation here except that I was able to borrow $1000 off of a buddy to send in the AOS packet. I think there are alot of us operating pretty tight these days, upsidedown on our mortgages, taking on credit card debt etc. Just got to stay positive, make good choices, know that things will eventually get better and you will see that month where you actually take in more money than are your expenses. I sometimes long for a month where you don't make a cash advance off a credit card to put in checking to cover a bill. It bums me out that I was not in better financial condition on her arrival 6 months ago.

yeah and now i am taking up free nursing assistant classes in the reservation hoping that they would let me be employed so i can help my husband on our daily budget coz i know how much he had spent for this process just for us to be together and i feel so helpless now i thought that we woul.dnt have anymore problems once we get here like we can start our lives livnng like husband and wiofe helping each other and enjoy things now that we found out we have to pay another thousand we started to live below our means so to be able for my legal stay in the US . But yeah .... i wish im still good for this in three weeks

I feel your situation too, but have to ask. Instead of taking cash advances on your CC to put the cash in the bank to cover bills, why not just pay the bills with the credit card and save the daily interest on the cash advances? Cuz the interest on those cash advances add up so much faster than purchases. Just wondering. But I am like you and OP and my fiancee not even here yet! She's due for medical and interview soon and has money I sent already for those and I have cash stashed for her airfare here and will send when that time comes but I'm getting short in the pocket and CC limits are close to max! I do have work bonuses coming in December this year and February next year that will help. And I agree with your advice on staying positive and looking ahead because this is all more than worth it to me!

I think you'll be fine after your I-94 expires. Yes you'll be out of status and yes its best to file AOS before that but I read here in VJ many do not file right away and do not have problems as long as they don't create any situation that give cause to a Government official to look into your case. You guys are married and do intend to file as soon as you can. On another note I think its great that you recognize your husband's efforts and sacrifices for the K-1 process and to get you here. I am sure ( I hope) that he also acknowledges the sacrifices you have made to be here with him. While yours may not be measured in dollars and cents, I feel that yours (like my fiancee's) is in many ways the greater sacrifice because its not just money you fiancee's give up to be here (and yes money is important too) but your family, friends and basically a whole life you have known. But on both sides I think to acknnowledge and respect the sacrifices each makes to be together as you have shown can only deepen the committment and strengthen the relationships. Those along with the gruelling ordeals of the K-1 process and the waiting and seperation, I feel we should all rember them especially when our relationships hit little snags which they will do at times. Might help to bring things back into proper perspective.

You should be fine waiting to file. You will be out of status, but if you were to get pulled over or detained you would most likely just be told to file your AOS paperwork ASAP. Depending on how long it takes you to actually file your AOS packet, you may not be able to use AP and instead have to wait to travel to your country (if you intended to) until your green card is processed as after 180 days of overstay you will incur a ban if you leave the country. Additionally, if you wait more than a year past the time when you had your medical done to file, you will need a whole new medical done.

You also won't be able to work until your EAD - filed for free with your AOS packet - arrives.

There is no fine or charge. The sooner you can do it, the better. Hopefully your money problems are just immediate, temporary problems and not long term and you will be able to file soon - keep in mind your spouse will also need to fill out an affidavit of support for you, so his income needs to be at or above 125% of the federal poverty guidelines.

No.

You I94 gives you 90 days in which to fill the visa requirment ( get married ) or leave the USA. If you have married, you have fulfilled the requirments. There is no time frame on which to file the AOS, I know someone coming up 2 years now because the petitioner doesnt make enough money for the Support Forms, so she cannot file for him. Basicaly, you have no status at all during this time. Youre not illigal, because you entered legaly, but your not a PR, because you dont have your greencard. Your just in limbo.

I worried during this time, mostly about ICE. I live in Texas and the illigals crossing the border is a big problem here. I would hear ICE stories all the time. It wasnt until I found out that they are 1) only interested in people who are here illigaly and 2) That those people have criminal records and are considered dangerous. I was niether of these and that set my mind at ease.

Just an FYI you need $1070.00 ($985 + $85 biometric fee for a total of $1070) for AOS. I'm only mentioning it because I can sympathize with your struggle and I'd hate to see you gather the wrong amount and delay the process even more. Remember that the EAD and AP are free and included with that fee so dont forget to file all three together when you do! :thumbs:

On top of everything that was already said, if you can afford to send in the AOS before your medical in PI expires (within one year), send it in because if you don't

you are required to do a complete medical again and more expenses. Good luck!

You'll be fine after your I-94 expires. Some people waited til 1 or maybe even 2 years to file AOS. As long as you got married within the 90 day time frame after arriving in the US with K1 in hand, you are good to go to file AOS, even though if you guys aren't financial stable and file later.

File for AOS as soon as you can. Tell your spouse, the sooner you can legally work, the faster you can start contributing financially.

Each K-1 who files for AOS will become out of status, even if they file the day after getting married the day they get off the plane. Stop scaring people!!!! ICE is not waiting with a warrant for your arrest the day after the ink dries on the Marriage License!! The one legal responsibility was to get married within the 90 day window, which coincides exactly with the arrival date. That is the 90 day window. If the K-1 did not marry before the I-94 expiration date, then and only then will there be a price to pay with USCIS!!! Please show to all of us any documentation which gives a deadline for filing AOS. Please site US Immigration Laws.
