Timeline

We are getting married next week so are starting to try and organise all of the AOS stuff but i have a question about the I864. I'm not sure what we are supposed to put as Travis' annual income. he doesn't earn a set amount, it's a little different every week, and he's only been there for three or four months so we have no idea what to put as annual income. Do we just put what he's earnt so far this year? We know he's under the poverty line though so we're using a co sponsor as well. Has anyone else had this problem? he's never had to file a tax return or anything either so we can't go by previous years income or anything like that.....

12/07/11 Sent AOS package

12/09/11 AOS package delivered

12/14/11 Received NOA for I-485 and I-765 (we're not applying for AP)

12/22/11 Received letter for Biometrics

01/04/12 Biometrics in Phoenix

01/31/12 Received email update from USCIS saying that we've been scheduled for an interview

02/03/12 Got an email saying card production had been ordered for my EAD...now just to wait for the card...

02/09/12 Received email saying EAD card has been sent

02/13/12 Received EAD card :D :D :D :D

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

Alot of people have this problem due to overtime, etc., I suggest adding up income on all the paystuubs and dividing that by the number of weeks worked to get an average weekly salary, then multiply by 52 to get an average yearly salary. Send in your paystubs to back this up and you should be ok.

12/06/2011- received email and text from USCIS with MSC number

12/07/2011- check was cashed

12/10/2011- received NOA hard copy dated 12/05/2011

12/12/2011- received NOA hard copy for biometrics appointment for 12/28/2011

12/24/2011- received NOA hard copy stating that our case was transfered to CSC on 12/20/2011

12/28/2011- biometrics appointment completed

06/25/2012- put in service request

09/12/2012- AOS approved

09/17/2012- card production

09/21/2012- greencard in hand

ROC Timeline

08/04/2014 - sent ROC packet

08/13/2014 - received I-797, NOA, dated 08/08/2014

08/28/2014 - received biometric appt. letter for 09/11/2014

02/25/2015- ROC approved

Timeline

If he is a wage/salary earner then take an average and annualize it to get the yearly amount.

If he is self employed, then last year's income shown on line 22 of the form 1040 tax return is the income amount used. From what you've stated if self employed then a joint sponsor will be required.

Thanks for the info guys! He's not self employed but he works at walmart and they tend to give him a different amount of hours every week...just to be a pain in the ####, lol
