hey everyone, im new in here and i have really big problem. hope someone can help my VAWA case.

i filed my VAWA on February 2011. After 2 months i got a Prima facie determination and they also gave me the EAD card around August. But on Sep 22, they sent me addition request of evidence. They need me provide my husband citizenship information (like passport copy, birthday of cert etc....) but unfortunately my husband disappeared a year after i got the order of protection for criminal court. nobody can find him (even police,lawyer and private investigator).

i dont have much information about him. i just only have his SSC, driver's license no., but they all cant help me to prove his citizenship.

Anyone know how can i get what citizenship he is?

How long i need to respond what USCIS request

do u think i can call USCIS to get help coz we didnt divorce, i still his wife(even he disappeared)?

if i cant provide what citizenship he is, what USCIS do for me?

Hi,

I went through the same thing, i had no physical proof of his citizenship other than my word. what i did was, i sent our marriage certificate, his full names, his date of birth, and i also wrote to vawa explaining why i cant provide proff of his citizenship. his pictures will also help. they have ways of getting the information themselves, but you have to provide as much information as you can about your husband. eventually mine went through, with only my word, pictures and the info i just wrote above. I hope this helps, also always seek advice from a lawyer. I did for advice only, but did the whole application myself.all the best and good luck.

Dec 12th 2010 Approval Notice sent (screeeech!!moved and forgot to update my home address!! aiyaiyai)
Apr 12th 2011 Application for action on an approved petition sent
May 2nd 2011 Duplicate approval notice received
Sep 9th 2011 I485 and I765 applications sent
Sep 14th 2011 I797C NOA received
Sep 16th 2011 ASC Biometrics Appointment Notice received
Oct 14th 2011 Biometrics Done
Oct 25th 2011 EAD Card production ordered
Oct 26th 2011 EAD Card sent to my home address ( thank God!!)
Oct 28th 2011 EAD Card in hand. Thank you Lord
Nov 14th 2011 I 485 Case transferred to NBC to speed up processing.what does this mean???

waiting.....the whole year of 2012 passes by without a word!!

Apr 17th 2013 I get a letter asking for a I 864W form to complete I485 processing and its orange in colour

Sep 10th 2013 I 485 Interview

I wasnt approved that day, was given another date after the IO requested documents i had that were not very clear to her to be notarized by the court.

Oct 4th 2013 Went back to the IO with the requested documents and she said the decision will be mailed to me.

Nov 1st 2013 I got my I797C USCIS Notification Letter of Approval of my I 485

Nov 8th 2013 Green card got mailed to my address

11.12.13 received my 10 year green card. Thank God. Journey Complete

thank you for replied me. i already sent what i have. our marriage certificate, his full name, date of birth,SSC no, driver's license no and New York Physical therapy no. but they still said cant find out what citizenship he is. do u remember when u got the REF what they wrote on it and what they want the addition evidence request?

And i remember when we on criminal court for domestic violence, the judge asked him about citizenship, he said "he is citizen". that's y i called my D.A. yesterday, she can provide the count record to prove his status but she also said that might not help because the immigration said, they need citizenship evidence.

i called the immigration dept today. they transfered to VAWA immigration dept but nobody pick it up and i left the message. i dont know when they reply me. :( stress me out

do u know which immigration dept and handle it? do u think they will help me?

You need to get yourself a lawyer. I don't understand though, after sending VAWA your husbands, ssn and drivers license that they would still question his citizenship. Mind if i ask, but is your husband originally from another country and is now an american citizen or how is he a citizen? I ask, because when they asked me for RFE i sent my husband's picture, date of birth and a copy of our marriage certificate. i didn't even send his ssn, but they found his info and proved his citizenship and hence my approved I 360.

I don't understand the part about you being in court and the judge asking him if hes a citizen, and the judge taking his word based only on his acknowledgement. Your husband has to prove his citizenship, by either a birth certificate or passport and other documents. I also dont understand when you say the DA will provide records to prove his status.It just doesnt add up, or am missing something in what you wrote.My dear, you need to book an INFOPASS appointment to talk face to face wth someone in that office about your case. making a phone call, and leaving a message for them to call you back, WILL NOT WORK!!

Of course they will help you, don't stress yourself too much. I understand your case because it is a bit similar to mine. It all depends with your case and the evidence you provide. Are u sure your husband is a citizen? Please make that appointment and they should be able to clear out whatever glitch it is that's causing vawa to request proof of your husbands citizenship, even after providing all the info you had to them. i still not respond the RFE, but when i filed the VAWA, i sent all my stuff i had. but end up i still get REF. i want to ask did your situation to me? did u send when u filed then after u still get the RFE for prove his citizenship? is it normal what they do?

I don't think he's actually a USC. That's the problem. If he was his SSN would say he is (just like my husbands says he is). So if you gave his SSN it should have been fine IF he was a USC. So it's either not his SSN, or he's not a citizen.

The court record where he stated he was a citizen doesn't prove anything. A lot of illegals will say they're citizens so they don't get into trouble. I'm sorry but if that didn't work I really don't know what will.
