Hello everyone,

I sent in my N-400 package on Oct, 10, 2011, and it arrived in the AZ lockbox on Oct. 22nd. I became a permanent resident on Jan,16, 2009, and married for 3 years and 3 months.

USCIS returned my package today and said I filed before I am eligible?! My package arrived only 4 days before the 3 months prior to 3 years benchmark.(based on 3 years' marriage to U.S citizen)

What should I do now?

They are very peculiar when it comes to submitting in advanced.

In fact, it is 90 days and not 3 months. USCIS can reject the package even if it is only one or two days early.

You should be able to resend the package now. They did not cash your check, right?

90 days is 90 days USCIS does not accept it a day earlier.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

No, they didn't cash the check. They stamped on it tho, so I had to write a new check. Also, I had to redo the N-400 form, since I dated the old form Oct. 10th, 2011. That's the right thing to do, right?

Ok, then! Lesson learned!

Yep, new form, new date, new check, and you are set to go. You are actually lucky that they sent the package back so quickly.

The law is the law, 55 means 55, I am telling the truth when I say I got a speeding ticket for doing 56 mph, JP explained it this way, the law is like a plate of glass, once its broken, its broken. Stepdaughter was barely 14 when she came here, due to extensive delays in our AOS further complicated by the USCIS misplacing my I-130 on her putting her condition green card 45 days later than her mom's. This put her barely over 18 when my wife was eligible to apply for citizenship. No arguments against the USCIS, 18 is 18, so she had to wait another two years.

Same with my unmarried stepson, barely over 21, could not petition for him, his mom had to, going on seven years now, he is still in Venezuela.

In debating applying for the N-400, do you count the day of your third anniversary, or start counting the day before that. Did count that day, because even though this is nebulous, they could reject the application for send it one day too soon.

But in other forms of government, 18 is not 18 anymore, trying kids under 18 in adult court due to the nature of their crimes.

It's best to even wait a few days after the 90 day period. There have been people that have filed right on the 90th day and had it returned...

Also would consider about same day oath offices. You don't want to have interview before your 3/5 year anniversary and oath after anniversary.

Best case scenario: interview + oath on the day after your anniversary.

Oh, thanks! My PR 3 year anniversary was Oct. 26th, 2011 and wedding 3 year anniversary was in July, 2011. So way passed those two dates...

I live in San Francisco. Is it a same day oath office? Can I file else where?

I would wait another month to apply if i were you. San Francisco office is very quick and most likely you will have your interview about a month before your anniversary date if you apply now. That means additional waiting time to be approved and then more waiting for the oath ceremony. If you apply around 60 days before your anniversary, most likely your interview will be after the anniversary date and you will be eligible to be approved right away. You should check the other SF applicants' timelines.
