Hello,

I applied for citizenship on 12/20/10. After a while I was invited for an interview.

I was interviewed by a supervisor. It was quite an lengthy and exhausting procedure. Eventually she picked on my marriage and I felt I'm interrogated.

The interview ended and I had to send in documents to prove that the marriage was for real. I had only two new documents, the rest they already had.

After 3 months I called in to see what's happening. Since it passed only 3 months I was told to call back after another month. After a few days I received a letter stating

"WE HAVE DETERMINED THAT YOUR CASE WOULD HAVE A BE BETTER RESULT IF YOU MAKE AN APPOINTMENT .......... USING INFOPASS ......

I called again after about a month and I received the same letter again. Their recording is useless.

So!? What this means? Is my case waiting for my appointment? So why they don’t invite me for a second interview, formally? This letter doesn’t sound like a MUST.

I would make the infopass appointment and go see whats going on. infopass is not an interview, its for you to go and find out in person what is wrong with the case and why its taking so long. Obviously phoning them is not helping you should go in and find out whats going on.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

They want you to make an infopass appointment, so they are unlikely to give you info over the phone.

What evidence of bonafide marriage did you send? Are there any red flags in your case such as you didn't have three years joint tax filings, or your husband's name is not on the birth cert of a US born child?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks to all the responds.

I sent in copies of what they already have including a letter from my ex wife explaining our difficulties living together and a copy of an apartment lease on both our name. This was our last attempt to try to work out things between us. Since she earned much more then me we never filed togheter.

If you are in good terms with your ex-wife, maybe she can go with you to the INFOPASS appointment.

SO….

About 5 weeks ago I had my infopass appointment. Waited 3 hours, while walking to the window a lawyer showed up so I waited another half hour; lawyers don’t wait in line.

I showed the letter….showed an ID and said my name, address and date of birth ……filled out a page with my name, address and date of birth…..

REP typed in the details and printed out a page with my name, address and date of birth….

REP stamped the doc and asked me to check and sign the doc.

REP…OK I’ll send this in and let them know you came and asked about your status. They have 30 days to answer you, after 30 days you can call in.

Me (understanding why they have those thick windows in front of them),…But that is why I came today (pointing to the invitation letter), can’t you tell me what is the problem?

REP….I don’t know what’s the problem I don’t work for citizenship!!

Since I know how government places are run and anyway I was totally exhausted, I turned and walked away. On the way out I bought a coffee and waked about half a mile to my car in pouring rain; no umbrella. While driving out from the parking lot the rain stopped, the sun came out and then I realized that I have too much sugar in the coffee.

BTW, I still have no idea what’s the problem.

ANY ADVICE?!?!

Yoji, after reading your comments, I got the feeling that either you are fed up or you have lost hope. If you are fed up, withdraw your application for citizenship and stay a permanent resident forever. If you have lost hope, do some research then consult a lawyer. You are eligible to file a case against USCIS since they have to adjudicate every case one way or the other (approval, denial or continuation) within the 120 days of the initial interview.

If you have not lied or done anything wrong that is.

I am definitely frustrated. Of course I want the citizenship but I don’t know what’s going on.

Do you know an organization in southern CA that help out free or for a low fee?

I might have a congressman but I’m afraid USCIS might be vindictive and reject me just for that.

(it’s not that I’m paranoid it’s all those who are chasing me)

There are plenty of people that can help you out. Get your congressman or senator involved. If you have done anything wrong why are you afraid. They are supposed to do a job and you are supposed to do a job. I have never heard of anyone's citizenship application being rejected just because he or she was trying to get it completed in a timely manner. I did hear of a case where USCIS found something in the record of the applicant and later on when he filed suit they presented it in the court and the court not only dismissed the petition but also, found the applicant to be in violation of the US Immigration Law so bottomline is, that if you haven't done anything wrong or lied anywhere on your application, then I don't think it is a problem.

You can find other good lawyers. One of them are Swanson and Swanson in Marina Del Ray. Look them up.

I have a buddy who is waiting for 7 years. Attorneys whom he contacted quoted $25K to pursue a legal route, "forcing" USCIS to speed this up. He's still hoping . . .

Your case actually freaked me out! I'm still married but we separated 4 years ago and that's why I applied for my citizenship after 5 years. Is it possible that they ask about my marriage or ask me to show them any evidence that our marriage was not fake? we were married about 7 years before we get to US and used to live together in our country.
