Hi,

I have some questions and hope that someone with similar experience could give me help. Here is a bit of background about my situation:

I am german citizen and currently working and living with an E2-Visa in Oregon. Before I was working for a german company on a project here in Oregon and stayed with a B1-Visa. In June 2011 I started a new Job at an american company and received the E2-Visa through them. I currently got engaged to an american citizen which I met in August 2010. We are planning to get married in Spring / Summer 2012 on Hawaii. Here are my questions:

1. Do we need to file any form regarding immigration before we get married or do we just need a marriage permit of the state where we are marrying?

2. Do we need a fiance (K1) -Visa or is my E2-Visa sufficient?

3. What forms do we have to file after we are married in order to receive a green card for me?

I would really appreciate it if someone could give me a bit help with this, I already looked on a lot of internet-sites but couldn't find any detailled description about a case like mine.

Your case is fairly simple. My husband had an E-2 Visa.

1. No need to file a form... just go through the regular procedure to get a marriage license and get married in your state.

2. Do not get a K-1 Visa. AS long as you have your E-2 visa and it is current you are legal in this country, but do not leave the U.S. at any time after your marriage. This could jeopardize your intent the next time you enter the USA.

3. Follow the instructions for Adjustment of Status after you are married. You can find them in the guides section of this site http://www.visajourney.com/content/i130guide2 . You will be able to travel outside of the country once your travel document (advance parole I-131) is approved.

2011-08-12 - (day 25) Touched - all cases online and on initial review - Receipt date: 07/18!!!
2011-08-12 - (day 25) All checks cashed.
2011-08-16 - (day 29) Received Hardcopies NOA for I-485, I-864 & I-131 (and a check back from a form that didn't need it)
2011-08-17 - (day 30) Received Hardcopy I-130 NOA
2011-08-23 - (day 36) Received Bio Appointment for 09/06.
2011-08-24 - (day 37) Walk-in attempt - unsuccessful - rescheduled for 08/30 (gained 6 days)
2011-08-30 - (day 43) Biometrics Appointment
2011-09-09 - (day 52) I-765 EAD card production email & I-131 AP approval email
2011-09-12 - (day 55) Interview notice received for 10/14
2011-09-16 - (day 59) EAD / AP combo card received
2011-10-14 - (day 87) Interview at Dallas Service Center. Approved on the spot.
2011-10-14 - (day 87) Email Approval Notice on I-485 - Online Case Status update: Card Production
2011-10-22 - (day 95) Received Green Card smile.png

I-751 - Lifting Conditions:

2013-08-29 - (Day-1) I-751 Sent to Vermont Service Center via Registered Mail - Delivery confirmed on 08/30
2013-08-30 - (Day 0) Package received
2013-09-19 - (Day 20) Checks cashed
2013-09-21 - (Day 22) NOA date 09/03

2013-09-23 - (Day 24) ASC Biometrics Appointment Notice Received - Date: 10/11/2013
