Our USCIS application was approved with no problem and our file was transferred to NVC. All seemed to be going smoothly, and we had our interview scheduled. We arrived a little early and were a little nervous.

The questions that they asked do not seem to be typical and to be candid appear to be unfair.

For example:

1) Where did I work prior to my current employer (I have worked at the same place for 13 years)

2) If he is related to my Ex-husband

3) Where I went to school prior to my last school

4) They said that they did not belive the marriage was "real" for the following reasons

a) I had no-one there (a mis-statement since I had 2 friends there)

b) We married too soon after my divorce (we planned to marry during the course of my divorce and were engaged for 6 months)

c) We did not wear "traditional" wedding clothing

d) His family members appeared to be the only ones in attendance

5) They looked at a photo of us in a nightclub and indicated that it appeared to be "staged"

I met my husband in December 2009. Since I met him, we have talked every day on the phone. I have been back March 2010, April 2010, June 2010, July 2010, October 2010, December 2010, April 2011 and September/October 2011.

There is an age difference...I am older than he.

Would appreicate any guidance I can get. I am talking to an attorney and will be visiting my congressman today.

Wow, you are scaring me. My situation sounds similar. I am older. We got married one month after my divorce. We have many pictures. I have pictures of me with his family and on holidays. I visited him almost 10 times in 2 years.

I have lots of cards, gifts, plane and travel papers.

But you are making me scared, his interview is next week. They said I did not need to come, but will anyway just because of the age difference and recent divorce.

Do not be afraid. You have evidence it seem to conquor an interview especially if your relationship is truly bonafide.

Relax, and since you know that the divorce and remarry within a month is a red flag area, u and ur spouse should study many questions around that.

X-Husband Questions that they will ask beneficiary:x-husband's name, when and why the divorce? how long were you guys married? any kids together? why marry after 1 month? when was the divorce final? and I am sure there are more questions.

I am sorry for what is happening. Please contact your senator or congressperson to let him/her know what is going on and to advocate for you: requesting a review and production of the embassy's policies guiding interviews (not the FAM). What do you think of reviewing immigration practice guides at your local law library for any administrative tips available? Stay strong.

When you have situations like this( where one spouse is much older and, or first marriage was short) always attach a letter stating the obvious. Say why the first marriage ended in divorce and why your'e in a relationship so soon. Since you have no family there, say on which visit to your fiends you met this person. Travelling 6 times for the year only shows your'e trying to establish a pattern and doesn't count towards the legitimacy of the relationship. The IO thought maybe you didn't give yourself enough time to get over the first marriage. A traditional wedding is always the best way to go. Every country has customs, values and believes, and i believe a traditional wedding is a part of it. The IO is looking for an established relationship and not one that seem rushed. The fact that you got married soon after your divorce and your spouse is younger, is a concern for your IO. when newly divorced, it's always best to be engaged for at least a year. Wish you and yours well. Good luck with everything.

This is a very thoughtfu answer. At this embassy, the interviewers take issue with 6 trips in a year. For my fiancee's interview in Lima on November 2, 2011 the interviewer questioned why I had visited 2 times in 18 months. We can see that the officials do not have an objective standard and they are arbitrary.

As for "traditional" weddings, whose tradition? In Nguyen v. Consulate General, Lexis 60399 (2011), the consular official denied Mr. Nguyen's K1 Visa petition because he and his fiancee allegedly had not had the "traditional" engagement banquet. The consular official did not even document any evidence like a work of anthropology or sociology to document that such a thing exists or which classes or cultural groups have such a banquet.

In your case, review those cases and the bad faith cases. US Citizens and LPR nationals have constitutional rights to due process fairness and the right to form a family through marriage. These attached cases and others are supportive of your efforts. In short, stereotypes and myths of how old, what kind of ceremony, etc, should not be used by any agency. So, educating the consular officials as to what the experience and limits are for you and your spouse are should put everyone on notice that the officials have a bad faith basis for arriving at their conclusions.
