So I'm back with new questions. I am now living in California and is married, again with these new paperwork I'm a bit confused.

- Do I apply for a SSN first or can I submit my AOS first before I apply for SSN?

- For the SSN questions 5 (Citizenship) since I am a K-1 Visa Holder who got married within 90 days. I am an Legal "Alien Allowed To Work" right???

Please help.

You do not need your SSN to apply for AOS. You can apply for it before or after AOS- it's up to you. When I applied for my SSN I said I was allowed to work even though you can't until you get your EAD or green card. I received my SSN with no problem. I've heard some people said they were not allowed to work and still received their SSN though. However I think you're supposed to say you're a legal alien allowed to work. My SSN says that I am only allowed to work with DHS authorization so it seems like they understood my application...

No - you're not anything right now - you have no status (that's why you're applying for AOS) You are not allowed to work until you have your work authorization. Come with your amrriage cert and your passport with the K1 VISA in it, that should be sufficient.

I guess it's 6 of 1 and half dozen of the other..Pocheros was successful when indicating YesPlease help.

One little tid bit for you. If your I-94 is within two weeks of expiring then you will have to wait until you have the EAD card or GC to apply for the SSC which will mean you will ahve to file the AOS without a SSN which is not a problem. If you wait to file for the SSC after you receive the EAD or GC then your SSC will not have "Not valid for work without DHS authorization" which is the GC or EAD. For the SSA you are "LEGAL ALIEN ALLOWED TO WORK" but look at the I-9 form and you will see that you cannot work legally until USCIS issues you an EAD or GC.

My I-94 expires on Dec. 9, 2011 and if I get my SSN & they don't allow me to use my marriage name & have to come back to change it then I will run out of time. I think I am just gonna submit my AOS without my SSN, but my other question is do I use my married name on my AOS?

You use whatever name you want to be your legal name on the AOS. If that is your married name use that. You should have time to get the SSC before the I-94 expires even if you have to get it in your maiden name first and then change it to the married name. The number is the important part. I think in my entire life I've shown my card to someone two or three times. Most of the time all you have to be able to do is rattle off the number. WHen we went to put my wife on the checking account he wanted her SSN and I gave it to him as I have hers memorized and she does not. He never asked to see the card. My Mother went by her middle name maiden name and married name her entire life, but her legal name on the SSC had her first name and then middle and then married name. She only worried about it when she retired and started getting her SS checks. SHe then changed her passport and DL to match the SSC. Sure made it fun when trying to settle her estate, but that is another topic that deals with braindead investment employees not braindead SSA employees.

Go to the SSA with the I-94, passport with K-1 visa, a second form of ID just in case --i.e. birth certificate-- and marriage certificate and see if you can get the card issued in the married name. If not either 1) leave and come back another day, 2) ask to get the card in the maiden name, but you may be given some BS that now that you are marreid your I-94 is not valid or some other story. In that case just leave and come back another day or go to another SSA office and do not mention the marriage and get the card in the maiden name. Then go back and change the name to the married name. You should be able to do that with just the SSC, ID and marriage certificate. Unfortunately the SSA employees are either very knowledgable and you get it done correctly or they are as dumb as a box of rocks.

You have a bit of wiggle room here but not really. :)

I would suggest you apply for your SSN with your married name. In the application you put alien - not allowed to work, that's what I put for my husband.

As for the AOS it really does not matter whether you have a SSN so it's up to you. If you are going to wait to file AOS then get the SSN first, if not just send the AOS out and then get the SSN. Considering all of your documents will be in your married name in the future you would want your green card in that name as well. I would put the married name and marriage certificate will prove everything they need to know...
