EAD WHEN CAN SHE WORK?

I have a question about all this... Is there not a 90 day time limit in which your EAD is supposed to be issued?? If they do not issue within this amount of time, can you schedule an infopass appointment to get an interim EAD?

My situation is I have an employer that wants to employ me and will wait the 90 days, but everyone seems to be past the 90 days when they recive their EAD>

So, if I am assertive and pro-active, would it be smart of me to schedule an infopass appointment a few weeks before the 90 days are up?

I just want keep this employer..know what I mean. So what's the deal with the 90 days? My DO is Boston and I hear they are slower.

Yes, USCIS has a rule that if 90 days passes from the date of receipt of properly filed EAD application, you may obtain an interim EAD by appearing at your local office in person. The important date is the receipt date, which is on your NOA for the EAD. Receipt date is a few days to a week ahead of the NOA date, so count 90 days from the receipt date. Schedule an infopass appointmet on the 91s day from receipt. If you come earlier than that, they will turn you away. It may be a good idea to take care of scheduling the appointment a few weeks in advance, depending on how busy your office is. Some people report that they can only get appointments a few weeks out. So if you want to be really proactive, then take care of it in advance, and if your EAD arrives you can always cancel the appointment.

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Thanks for all the help guys. I will definitely keep an eye on this. Let's pray I don't get to the 90 day mark. I have no idea how fast Boston is processing EAD's...I'm not sure is there a link somewhere? I have looked but when I go to Boston it isn't showsing timelines for EAD's.

I'm happy to finally be past part 1 but onto more waiting. I should be getting more patient, but I don't think it's working. lol.
