I'm sorry to "jack" this post but I mailed by packet today without my NOA2...I have in fact lost it :(

What is the likelihood of being approved without it?

Again, no. This doesn't PROVE legal status. It proves they applied. Please read my previous post.

I was talking about in general terms, for those who are waiting for their AOS, (though perhaps I misunderstood Dan and Jeni's question). But for those K-1ers whose original I-94 has expired, have got married within the 90 days and have applied for AOS (and received their NOA1) but they do not yet have the AOS NOA2/EAD/GC, how else can they show they are in the US legally if they are questioned? The AOS NOA1 shows they have a pending case (unless they have since been denied, as you point out), and the marriage certificate and I-94 show they have done the right thing.

That's what I'm saying. Technically they can't. They can prove the applied, and they can HOPE it means ICE will let them go, but it doesn't prove that they haven't been denied already. I doesn't prove the case is STILL pending. It's likely they'll just be let go, but there still is a chance they'll be detained.

In fact sometime last year a girl and her immigrant husband were on a bus to another town. They had applied for AOS and had the NOA1 and all that. He was STILL detained.

You won't get deported, but you MAY be detained until you go before an immigration judge who releases you pending AOS approval.
