Hi everyone,

I just received my I-485 AOS intial interview document. It asks for I-864 and required evidence. But I already submitted my I-864w documents Immigrants Affidavit of Support Exemption (I have been working in the US for over 10 years now and have enough SS credits). Do I need to prepare my wifes (sponsor) I-864 documents even though I am exempt?

any advice would be greatly appreciated. thanks in advance,

Mike

Did you get an RFE? (was your 864W sufficient in evidence?)

Or are they asking you to bring stuff to the interview?

If you qualified for the 864W - that should be sufficient to bring (with the evidence) to the interview.

I would call them/make infopass to resolve this issue.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi, thanks for the reply.

I did not get an RFE. There is a list of things to bring to the interview on this appointment document. Most of which I submitted with my original application (I-693, originals of all the copies that I sent in etc.) These all state"(unless already submitted)" so it seems to my like its a standard reply for ALL interviews instead of a specific list per applicant. Do you think I can safely assume the I qualified for the 864W since I didnt get an RFE? Or should I have recieved a letter saying I-864W approved?

to play it safe I may get my wife to gather all her financial docs just in case, even though I easily qualify for the 864W exemption.... any thoughts?

I would think since you didn't get an RFE - it's cool.

Yah - that statment "unless already submitted" is a catch all - if you did - then your cool.
