hi there

well my interview ddnt worked out well and ive been refused

the lady their said that i ddnt convinced her of our relation

she asked a lot of questions and i answered them all right except one question of when my wife divorced

she gave me a white paper that am refused and that i cant receive a visa under the section 221(g) which prohibits issuance of visa to anyone whose application does not comply with the provisions of the immigration and nationality act..... YOUR FILE WILL BE SENT TO USCIS OFFICE IN THE US FOR POSSIBLE REVOCATION AND THERE THE FINAL DECISION WILL BE MADE.

WHAT SHOULD WE DO NOW HELP PLEASE?WE ARE FEELING BOTH LIKE ####### ESPECIALLY THAT WE DO REALLY HAVE A REAL RELATION AND THEY CANT BELIEVE IT!

Sorry to hear that you got refused!!!

Besides having a relationship you need to prove them to the CO. By being in a high fraud country makes things even harder. Have you had enough evidence of ongoing relationship?

There is really nothing much you can do. The only option you have is to withdraw a petition and start the new one. But make sure to have a really strong case, with tons of evidence. I don't think that you got refused just because of the divorce question. (I don't remember my own divorce date). There gotta be more to it, and it is you responsibility to proove to the CO that your relationship is real.

Good luck hopefully it will all work out.

OH and wat about them sending the file back to the uscis....i thought they will ask for more evidence and study them and resend the file for a 2nd interview?

Most of the time if the file is going back to the USCIS is for "Intent to Revoke/Deny". It can take months before you will here anything back. If they needed more evidence the CO would've ask for it. USCIS have nothing to do with that.

how long ur case take from the date of fill i-130 till the interview?

The only option you have is to withdraw a petition and start the new one.

Incorrect, withdrawing the petition and starting a new one is not the only option.

OP, when USCIS receives the petition back, they will either reaffirm it and send it back for another interview or issue a Notice of Intent to Revoke (NOIR) to the petitioner.

If the petitioner receives an NOIR, it will state the specific reasons why the notice was generated and a deadline for sending a rebuttal. When sending a rebuttal, the rebuttal must address the specific reasons stated in the notice. After the rebuttal is received, USCIS will make a decision (reaffirm or revoke).

IMO, it's probably better to ride this out because if USCIS does indeed decide to issue a NOIR, the specific reasons behind the visa refusal will be known and can be addressed in a rebuttal.

All correct. What the OP needs to do immediately is write a detailed report of the interview experience from arrival to departure, including a description of everything that happened leading up to the first question asked in the actual interview and then as close to verbatim as possible, a transcript of the actual interview including the questions asked and the answers given. This will be critical for anybody helping you with your next steps, whether that is the members here or professional assistance you hire.

Ezzat i agree with Ryan H, what he said is what the uscis will do, but he can stop the petition from going back by contacting your congressman or the senator. But if it goes back, it may take about 7months to give an intent to revoke/deny, and if you are given intent to revoke they will give you 30days to respond, and when you respond, they will decide either to reaffirm the petition or to revoke/deny it, but that's not our wish. You can still do something by stopping the petition from going back the uscis.
