Hi guys

Just read someone else's post. said they applied student visa before K1 visa when they were in the relationship.and then failed the interview.

So I am here ask for help bcs I kinda in the same situation

First 1 year ago me and my husband met in China.became friends with each other. and then I went to apply for B1B2 visa cus I was working as international sales person in my company and my husband wanted to purchase some from my company since we are friedns we thought it would be nice that we could do busniess together.

But I got turned down and then my husband called US embassy provided all informations about his company and so I went to interview again got B1B2 visa.

But since I got turn down and went to interview again we lost lots of time so by the time I got my visa in my hand we already missed the sales season so we didnt make contract.

2 months later I went to US as a friend of him. visit his family his son (since he and his son went to china before,so we know each other)

time goes by we fall in love with each other, we spend almost 24 hours 7 days together and everyday just got better. so after 6 months I been there we got married, Stupid me heard someone wrong advise that I can stay there since we already married that I can stay legally by naturalization , but later we found out its wrong, by then I alreayd overstay my visa for 8 days.so we went to see the lawyer and she told us right thing to do is go back to china appy for CR1. we wanted to do the right thing so I came back to china a week later by then I overstaied for 14 days.of course there is a report about me and my husband saying that I overstay and probably saying that B1B2 Visa was our plan for me to stay in USA, (My husband got a phone call from US embassy saying he was going to report about me for overstay and he said this was your plan from the very begining)

Now we finally finished all documents we have showing that we have a relationship together we spend time together with his family and so on.

My concern is:

1.Will they put me in fraud investigation bcs it was my husband Invitated me go there and 10 months later we get married, now its been 1 year since B1B2 visa interview and we are now applying CR1 Visa,

2.bcs I overstay for 14 days ppl told me i dont need to apply for hardship waiver but is that a big issue for my case?

It's not visa fraud because you returned home--probably wouldn't have been visa fraud even if you stayed based on what you said. And the overstay was less than 180 days, so there are no bans involved, so no waiver required.

You might be questioned at the interview, but it is not too likely, and if you do, just tell the truth...you went back home because it was the right thing to do.

We also have big age difference. 26 years age difference. I am 29 next year will be 30, he is 56

Now do I have lots of red fleg base on my situation? Thanks guys

Age difference won't be a problem as long as you can show that your relationship is real ad genuine. Most of Asian women are marked by label of looking for US citizenship and to get out of poverty situation and they start looking for rich white men. So the relationship is considered fake. But I believe there are some good women who are NOT like them, I think you'll be just fine, keep the faith smile.gifsmile.gifsmile.gif

Yes, I suggest you apply CR-1 visa instead of B1 visa as you are married already.

no.....you misread my story

I already got B1B2 visa, now I am in my home country applying CR1,but since my husband was the one who invited me to go to USA have a busniess trip, I wonder if it will be an issue with my CR1 Visa bcs I didnt go to the busniess trip I went visited my husband as a friend back then and we got married , also I overstay for 14 days...

You overstayed the B1 by a few days, but you left, that is the important fact.

You got married and you exited the country, then your husband filed the I-130 petition. You did it the right way OP so as to aviod the issue of fraudlent intent.

The fact you got married in the US is no big deal, relax, you should be fine.

no.....you misread my story

If you are questioned during your interview about the reason for getting the B1, be truthful. Your intentions were for business, that is the point you make.

Yeah relax, read again my first post to you. You did the right thing by leaving the country, that shows you had no intent to immigrate.

Now stop letting the CR1 almost kill you, you just got married! :D
