(Philippines Case: US Citizen petitioning Spouse/Children

Hello,

Im confused about which form to fill out for the Affidavit of Support. I filed for 3 separate I-130's for my spouse and 2 minor children. I guess my first question is how will I determine if I meet the required income bracket for three applicant? Coz Im not sure If I will fill out only the I-864EZ which basically me saying that only my income will be used. I mean I can have my parent and sibling use their income too so I dont really know. Just the fact that it stated there:

All three of the following are true for I-864EZ

* You filed a Form I-130 petition, for your relative

* The there is only one applicant on the Form I-130 petition, and

* All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive.

...is what gets me confused a little bit. Think its safe to start off everything using the I-864 with I-864A using household member? Being a US citizen does not put an exception on this rule right everybody must meet the income requirement? Thanks

For a family of 4, it is $27,937.00. If you're from Alaska it is $34,925.00 and if you're from Hawaii it is $32,137.00.

if you meet or exceed the income requirement, there is no need for co-sponsor. I think it is a good idea to use the

I-864 instead of I-864EZ since it is for your spouse and 2 kids. I-864EZ is used if it is for 1 applicant only. I do

understand that you filed 3 separate I-130 w/ 1 applicant. If you follow that logic, you would file 3 separate I-864EZ.

Please correct any of this if it is wrong:

You are a US citizen. You petitioned separately for your husband and minor children. How old are your children - are they under 18????

For your children under age 18, you can file an I-864w which is a waiver of the I-864 requirements. The reason you get to do this it under the Child Citizenship Act (CCA), your children under age 18 are automatically US citizens if they enter the US on immigrant visas to live with a US citizen parent. You can apply for US passports for them after the enter the US on their immigrant visas.

You need to figure out your household size and if you meet the 125% poverty level. Google "I-864p" for the poverty guideline. Your household size will be at least four; you, your minor children, and your husband. You would need to include any other dependents and other immigrants you have sponsored.

You can file Form I-864EZ for your husband if you are only using your the income stated on your W-2. Your joint sponsor can not use form I-864EZ; your joint sponsor must use form I-864.
