Police investigation Update!

The link above is my story in case nobody familiar about my story on here.

Okay i found out by the cops that my husband said I burnt him with an iron

however the cops do not believe that lie because they went to his workplace and they believe it happened at work.

The firs thing they did was talk to his boss who of course is jamaican took up for him and said the burnt did not happened there on the job .

So the cops talk to my husband and he said that i burnt him with an iron! I cannot believe he made up that lie, the cop said why would somebody find a nasty ole condom and run go plug up an iron to burn your hand.

Anyway they couldn't get him to confessed that he was lying on me he stuck with his lies and his boss sticked up for him as well.

So the cops asked if he wanted to charge me. He immediately tells them no because I am very nice and sweet person, but he just wanted everything documented.

So i said the cop wow i didn't know ppl that goes around burning ppl hands are nice and sweet. :rofl:

She said that he is definetly lying but she couldnt prove it so she is not arresting me and she believes that he is pulling these desperate act to stay in the USA.

However in this case there is nothing i can do but get a police report.. :help:

What is it I can do from this point on? is obvious that he is lying on me

Oh i found out that he is going back n forth to the doctor i guess to put stuff on his file about me..he is really trying to bld a vawa case around me and I do not even be around him or talk to him or nothing what can he possibly going to do the doctor for???

Please help what is the next step..I go see img/infopass next tuesday

It's not for me to police whether what you write here is true or not. I take things based on what you write.

So was a police report AGAINST YOU filed? I find your husband impossible to deal with and looks like he has a game plan. Why don't you write a letter to USCIS with his case number and full information and inform them of what's happening? I don't know if that will help, but maybe if he tries to file ROC he will be flagged for an interview?

It's not for me to police whether what you write here is true or not. I take things based on what you write.

Yes a police was filed against me, however the cops didn't believe his story and dropped the case along with my husband saying he didn't want to press charges against me because i am very nice and sweet person go figure.

Yes he has a game plan but it is failing miserably he is not such a great con artist after all..however he is still running to the clinic for what ?? I do not know why not even the cops no why they just know that it impossible that i burnt him with an iron when he works at a restaurant on big ole grill all day cooking food.

I already visit ICE got a case against him and withdrew the petition on him, and i have an appointment on the first to go see him so i am getting a police report and i am going to take all of my documents including the condoms and his phone record to them.

He been here less than 2 months and cutting up like this, even the cops said he is taking desperate measures to stay here in the USA

There is nothing for you to do - file for divorce and move on. I believe this was told to you in your other thread.

You need to make a report to ICE/USCIS - but now you have a police report (which is against you btw).

Unless these organizations do something - there is nothing more you can do, other than DIVORCE.

Why does it matter? You said he has a green card - he doesn't need to file a VAWA, he has the green card. He would just need to remove conditions (does he?) and then all he would need to prove that he married in good faith.

He would be still be covered under the affidavit of support you signed - and in the divorce, he could go after you for alimony - depends on the divorce.

Talk to them - give them your suspicions, file for divorce - move on.

If he files for VAWA, by law, USCIS will not tell you or contact you about this.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

They didn't file charges against him for a false report?

What petition can you possibly withdraw? You said he has the green card all ready. There is no petition now - what visa did he enter in on?

My husband got approved to move to the USA in May.

He got here finally at the end of September therefore he hasn't been here long at all.

He got his green card in the mail

Again - if he has the green card, why would he need "desperate measures" to stay? All he would need to do is divorce you and file for conditions, if needed - So, what visa did he enter on?

He doesn't have to build an abuse case to be able to stay here. Since he already has his GC, he just has to prove you two married in good faith.

Well - you were the person that married and brought over, you were suppose to do the due diligence for the relationship, not USCIS. This happens sometimes.

This is correct, unknown what evidence he has. However, he could make the case you were abusing him (nagging/shoving) and you drove him away. I have seen people ROC on less evidence.

Again - he simply has to divorce you and ROC himself. If he can prove he entered the marriage in good faith - then there is no need for an abuse case.

It doesn't matter if you divorce him first or last.

Just divorce if you feel that the marriage is over. Only you can make that choice - from what you posted - it seems your pretty convinced of his guilt.

You said you made contact with USCIS and gave them evidence of a scam - so the only thing left to do is divorce.

If USCIS finds your evidence to be true - he gets denied when he attempts to ROC.

If he claims VAWA, and can't prove it - he gets denied - but you will never know, that is the law.. I am not sure if the 864 still holds sway with a VAWA - I'm thinking it does, but have no experience in this.

If he claims ROC after divorce, and can't prove good faith marriage, he gets denied.

Your out of the picture now, for all intent and purposes.
