Hi Guys

I was hoping to get some answers from you

I was laid off last year and collected UI for about 6 months. This benefits show on my 2010 tax transcripts and had no problem at NVC. I am just trying to be prepared for consulate when we go to the interview in case they refuse to accept UI as income. I have been employed for about 11 months now making enough to sponsor my spouse and a bunch more

My questions is this

I have a friend that is willing to assist me and be a cosponsor. My friend make enough money to support my spouse plus oneself. the only problem is that she filed jointly with her parents last year.

What form does she need to file and what supporting docs? Can she be the only sponsor and file I-864 based solely on her income despite the 2010 joint taxes( providing employee letter and pay stubs) ?

Please help me :unsure::unsure::unsure:

Current income, not past year's income is what matters. (unless the sponsor is self employed). If your annualized present income meets the requirement you ought to be ok.

Re: your friend. No one files jointly with a parent or parents. The parents may claim your friend as a dependent. Or your friend may claim her parents as dependents.

A joint sponsor complete an I-864 and provide all the supporting documentation.

Thank you for your reply ANH map

I should have phrased my question better.

So my friends is claimed as a dependant on her parents taxes even though she made enough last year. Can I make use of her I-864 as a co sponosr? do i just need her W2's for last year or do i need her parents as well?

I am so confused

Your friend can be a joint sponsor. The friend needs to submit all the needed documentation. A W2 is only part of a US tax return. She needs to submit a complete tax return or IRS generated tax transcript.

Last year's income isn't as important as this year's current income. The sponsor would document current and ongoing income with paystubs and employer letter.
