Hello everyone, I am desperate for help....Oliver got his K-1 and is now in the states. After a lovely wedding Saturday night Oct, 22, 2011 we are unsure what to do now?

Please help with any step by step instructions on what it is that we need to do from here.

I'm so afraid that we're going to run out of time....he is scheduled to leave the States on Dec 13th and I can't bear the thought of it.

Any help is more appreciated than you'll ever know.

Edit to add. You likely will have to file all over again for a spousal visa if he leaves in December.

He cannot leave unless he has AP or the green card in his hand. You can try to get a stamp in his passport via Infopass but you have to have applied for AOS and AP and have the NOA1 already.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Not a good idea for your husband to exit the country before you have filed for AOS and received AP/GC.

File Adjustment of status and follow the guides...it costs $1070 file it asap if he wants to be able to travel abroad anytime soon.

Hmmm...you are asking for trouble; the K1 was issued for only one purpose...to get married and live in the US; he would need his green card before he is allowed to get back into the country or some travel documents...better follow the links others have posted to get more information. You have come a long way don't screw it up. Good Luck on the rest of your journey of love and life.

Um, from what I understand, the beneficiary moved on a K1 visa, is now married, and asking what to do next. I'm not sure why people are assuming that they've done something wrong.

OP, you've already met the K1 requirements. You married within 90 days of POE.

Now, you can file for AOS/EAD/AP and a SSN, and enjoy your life.

There is no time limit for you to file AOS. You're fine. That December 13th date is the date you had to get married by, I assume, that's listed on the I-94 in your husband's passport.

Unfortunately, it is unlikely that he will get the AP by then, which makes things really complicated. If it is not absolutely necessary, Don't leave the US until you at least have the AP. Otherwise, you have to start with the spousal visa application that will take many, many months.

I'm unclear as to whether or not the beneficiary WANTS to leave on the 13th or if they are under the impression that they HAVE to leave on the 13th. I thought maybe they saw the date on the I-94 and thought they had to file before that date just in case. That's what I got from the "I can't bear the thought of it.." .. maybe they are under the impression that they are going to be separated if they don't do something by that date.

The OP needs to clarify.

I completely misunderstood the whole thing! Thank you all for clarifying (i feel very stupid). I thought that the AOS had to be filed by December 13th (the date stamped on his passport) or he was to leave the country on that date. He does not want to leave, we were just under the impression that he would have to if the AOS was not filed by then.

The way she said it, it sounded like he's scheduled to leave the country on the 13th to visit his family or something. hahhaha

He cannot legally work nor travel until you apply for adjustment of status, so I'd get started on it as soon as you can. Congratulations!
