Timeline

Make sure you have lots of record of ties to Canada - job, house, banking, etc.

Also, be sure you have a backup plan incase you don't get permited to enter the US.

You *may* be permitted entry, but it is ultimately up to the POE border agent on whether you get in or not. During my CR1 process I was denied entry twice - even with my significant ties to Canada on hand.

My husband has crossed by air and by car lots of times since we started this process.

He carries with him a copy of the immigration documents, his passport (of course), a letter from his employer stating that he is on vacation and due back a certain day. This has all been sufficient to let him in.

Only once was there an issue and I guess the officer at the Calgary airport decided he needed to investigate further. The guy made half a dozen phone calls, to me, to his employer, to his landlord to verify that it was only a visit. Hubby ended up missing his flight but U.S. Air was awesome and got him on the next one to Chicago.

I thought over the summer we would have a problem crossing in a car for sure. I had been in Calgary for 3 months visiting and we had a car stuffed full of stuff. (hubby brought his golf clubs etc) the officer asked how he was getting back and he told her he would drive back in our jointly owned vehicle. No issues, went right across.

The way back was a nightmare for him. Our truck is now in storage in Grand Forks, North Dakota because he couldn't cross with it being titled and licensed in Tennessee. He ended up having a friend drive from Winnipeg, pick him up and he had to fly home to Calgary, leaving his truck, golf clubs and various other stuff in storage in North Dakota.

Yeah the process of crossing is very dependent on the POE officer. If you ever call customs to ask them what can you bring for ties to Canada and that you want to cross while you have an immigration ongoing, they always tell you that it is best that you don't because it's technically not allowed and that you would only be allowed in at the discretion of the POE officer.

When I tried to visit back in April and got denied I was downright treated like a liar and a hack by the officer I dealt with and he refused to listen to any explanation I gave him saying that I was lying consistently. When I went again 2 weeks ago I had more ties documents as a precaution but I gave the same answers as I had before to this officer and he looked at me and said, "I'm not going to lie to you, the last officer that handled your case said that you had been committing fraud" and I honestly told him that I had not lied then and I was not now, that I fully intended to return. I thought I wouldn't be let in since the past officer had said that I was committing fraud, which is a HUGE deal, but this officer let me in with a required return date for the day after my return ticket.

I understand that the officers have to be very cautious as to who they let in because there are people that lie and try to commit fraud but it still astonishes me that I was honest both times crossing and said the same thing but got called a liar and then the second time I ended up being able to visit.

That is such a rotten way to handle these special cases. That is such a rotten way to handle these special cases. Once when I was driving with my husband into Canada weeks before I had my CR1 approval, the POE told me that it was illegal for me to drive (at all) a vehicle in Canada, which was registered in the US. How stupid! I just gave my head a shake, where is the common sense in all of this? Go out and get the real illegals, not the ones who are going through the process the correct way. The system is almost broken, definitely very crippled. IMHO

Not to add to ur frustration,lol but it is illegal for a Cdn resident to drive a USA registered vehicle in Canada. Neiks our Cdn Border guard can add to that. It happens to Cdn Tourists that do the Alaskan cruises. They get into 1 of the Ports, rent a car, then drive up to the Cdn border. Guess what, legally they are not allowed in with a USA registered vehicle. Thats the rules and sure many do not realize it. Probably an insurance issue Your situation had nothing to do with immigration, by the rules you were in the wrong. The simple fix was the USA person drive the car. Everyone has their own opinion on the system, I will leave it at that.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

And u can bet an insurance company would jump on that! once he Is a perm resident of the USA he is good to go!

Many of the CDn POE guards may not even know the rule exists, so yes many do prob get away with it--but I bet the insurance companies know, if it is an insurance issue.

I put the car in a ditch during a snow storm in Maple Creek, Saskatchewan last November. First thing the RCMP officer asked "Who was driving?" and "Do you have your yellow card?" After he established we were not drunk and I was indeed driving and had a valid drivers license, yes they can check. I used the "I'm from the southern united states, sir. I don't know how to drive in blowing snow" excuse. AAA paid for the tow out and off we went.

Never heard of that yellow card thing! Was never mentioned when I called the RCMP about driving my Vehicle in the USA

It's officially called a non-residence inter-province motor vehicle liability insurance card. It's yellow and has all your insurance info in English and French. You're auto insurance carrier can issue you one and it comes in the mail. I have Geico and it took like a week to get it. I now just have them send me one every six months.

All it is is to prove you have enough insurance to cover you in every Provence and territory if you were ever to get in an accident. A POE has never ever asked for it, and other than having an accident I've never needed it.

Timeline

Tomorrow, my husband is going to attempt to visit me in the US. I'm nervous for him. He hasn't been here since June, and I haven't seen him since September when I went there. We want to attend a wedding and have him stay for Thanksgiving and birthday before returning home to Canada to finish out this process.

I just wanted to voice my anxiety to people who would understand. He's as prepared as he can be, but we all know how arbitrary it is! I'll let you know if he's allowed to visit.

I just found out the other day I get to see hubby for Christmas! I'm so happy!

Except I'll be flying to Calgary. I hope I don't get ####### for saying I'm going to visit my husband for Christmas.
