Visiting US while K3 is in process?

I am a Canadian citizen and my husband lives in the states. We got married a few months ago and our K3 visa is in process now. I am reading different things on whether I can enter the US or not.

So can some one please clarify if I can enter the US or not.

I believe you can, you just need to make sure you have a lot of proof of ties to Canada with you. examples, lease agreements, bills, employment letter or pay stub, if in school maybe documents that shows your registered.

I married an American too and plan on going to see him in 2 weeks.

Everything I have read says you can.. It is mostly just about having enough info to prove ties to Canada so that they do not think you intend to stay illegally. My fiance is coming for the holidays and we have him bringing tons of stuff with him: pay stubs, lease, bank statements and I think a couple other things that I can't remember. I also sent him the NOA1 to bring with him. If you haven't spent a lot of time here, then you shouldn't have a problem.

You definitely can. I just went about 2 weeks ago to see my finace for about 10 days and I have a K1 in the process. Like everyone said, it's just important to show that you have ties to Canada and that you will be returning. When I went, I had my my return ticket, I took bare minimum amount of clothes, I had my employer write a letter saying I am employed with them and returning after a certain number of days, and I had my parents sign a letter under a commissioner to show that I live with them permanently (since I couldn't provide a lease with my name on it). I also had my bank statement showing that I was leaving behind all my savings and would be coming back for them and I took my NOA2 to show that we were in the middle of process and doing it all legally. I did get pulled into Immigration at customs but I was out of there in just about 40 minutes or so. Just be honest about everything, and you'll be fine.

#1 question asked on this forum! Simply put, yes, BUT it comes down to the POE officer. So ensure you have ties to Canada AND a back up plan in case they deny you entry! Most have no problems, but 1 has to be prepared.

I thought the k3 process was dead? Really only makes sense if ur going through Vancouver.

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Don't recall anyone of late going the K3 process. It was taking the same length as the CR-1. it may be faster if you live in gods land--Thats Manitoba and Westward,lol as then you would goto Vancouver for the interview which is a lot faster at spitting out interviews. As I'm sure ur well aware all cr-1/ir-1 goto Montreal.

My husband is coming for a two week visit in November, and he doesn't have a lease (has been staying with his mother), doesn't have an employer (he is his own boss), and doesn't have hard copies of his visa paperwork (I have it all). He will, however, have a return ticket, a minimum of clothing, and a honest attitude. Fingers crossed this won't be a problem. Of course he'll be returning - his interview will be in December. There's no way he'd not return!

U could always mail it to him, or scan and email him at least a copy of it! I was never asked for evidence, and I traveled monthly to DC,never had a problem. But all it takes is 1 grumpy POE dude,lol I never really worried about it.

Border agents have an important job to do! U can thank all the people that try and enter illegally for why they have to be serious. And yes some probably get carried away. Border agents have an important job to do! U can thank all the people that try and enter illegally for why they have to be serious. And yes some probably get carried away. I got turned away at Champlain NY, 5 days before my interview in Montreal and it didn't matter what proof I had to show them ties to Canada, I got a young officer who was on a technical power trip, "technically" you are not allowed to enter the USA once you have declared an intent to immigrate which you do when you file the I130. I had crossed over many times before for 9 months without problems and then the last time I wanted to cross over to visit my step-daughter who lives 90 minutes from the border I got turned away.

It was extremely upsetting to say the least but he had the power and I was not able to convince him to allow me to enter even though I had my interview 5 days later.:bonk:
