Hi, I'm about to hire a lawyer to begin my VAWA petition. I was with a USC for 4 years (well we are still married but I finally got the strength to leave him after he put a knife to my face) he was a very bad man, who did wrong to me and caused trauma to our Autistic little boy. I'm scared, I'm already working of my statement it's 21 pages long! Has anyone been through this? I never knew about VAWA until one month ago. I never knew there would was help for me, I was so out of tune with the world, I was only 19 when i met him. Can anyone tell me or give me a sample of their statement or witness affidavit. I never called the cops because I was scared and he made me feel even more fear. Now, I have it very tough trying to raise my Autistic son, without having a stable job or money to meet his disability needs, and he's a very irresponsible horrible man.

Welcome Aboard Bananita! We are all in the same boat and hopefully you will find your story in these posts. I am very sorry that it happened to you but it also the time to move past that.

You might have to revise your statement many times in order to avoid inconsistencies and chronological discrepencies. Although, it is too early to predict, you may want to focus on those four factors along with why and how you think that abuse has any impact on your son. It may be helpful to your case if you can document it better.

I am sorry to hear about your situation and also the condition of your son.Like CASE2011 has said we all here to help one another with our walk in vawa process.You dont need a lawyer.I filed for vawa myself as a spouse of a USC for me and my 2 children that I came with from my country to come and marry my husband here in the USA.We been married for 5 years and we have a child together ,went through all kind of abuse.Never called the police was scared as I was threatend of being deported because he used that on me even though I came on a k1 visa and married him within 90 days and never filed for AOS.I went to see a lawyer who told me ,I wouldnt be approved because I didnt have police report though he said I have all documents to prove marriage and good moral character.Wend back home disappointed then I told myself i can do it.I typed a 12 paged statement which took me 5 days,my 2 friends who witnessed the abuse wrote me statements .I Started with how I met him,how we fail in love,about the plans we had for the future ,how he came to my country ,how I came to the USA,when problems started and how .I documented every detail and dates ,What he said ,how I responded ,how I was affected as a result of being abused.I ended explaining why I never left the house to seek help at the shelter because he had threatend to use that against me if we went to court for child custody he would accuse me of abandoning my child as he wouldnt allow me to take him to the shelter with me because he has his own house,he had even offered me money to surrender our child to him.I explained that I said 4 yrs because I wanted to see and be with my child thus enduring the abuse.I was approved ,if you have any questions feel free we here to help one another .Vawa forum is a forum that is on my heart becuase I understand what someone could be going through for I know exactly what they are going through becuase I experienced it .

I only have one photo of evidence of a bruise, and that's after I developed about 5 old camera rolls of film I had and that I had forgotten about. I would prefer a lawyer, but I don't know where to look, I'm consider a lawyer that's nearby, but since I have no police reports, he's contemplating working with my son's worker and a psychologist. This whole process is stressing, and I can't tell you how much I go through on a daily basis with my son, I'm on low batteries, sometimes I feel I'm going to pass out..thank you for the support.

WOW!!!! this is Dejavu in the weirdest form!! Lady g your story is a mirror image of my own...word for word on what you wrote abt what you went through...WOW...

As for our new member,

First, am really sorry you have to go through this with your child, it is hard, i can only imagine. I agree with the ladies above, you have all our support and advice, all you need to do is ask, i found so much love and support from people i dont know and probably never will, but the support system is amazing. Just keep your head up, and Its all going to be alright. I seeked an immigration lawyers advice, before i did anything, and after doign a lot of research and reading from other VAWA victims, i had the courage to do it all on my own, and without having to pay for a lawyer. just be honest, and provide as much evidence and proof as possible, even what you think is not important, might be the key to the whole process. As you will soon come to find out, most cases if not all, always get a notice for request for more evidence or RFE, so go back mentally into when it started and gather up all the evidence you have, it will greatly help in your case. all the best my dear, and am sorry you have to go through this. good luck.

Apr 12th 2011 Application for action on an approved petition sent
May 2nd 2011 Duplicate approval notice received
Sep 9th 2011 I485 and I765 applications sent
Sep 14th 2011 I797C NOA received
Sep 16th 2011 ASC Biometrics Appointment Notice received
Oct 14th 2011 Biometrics Done
Oct 25th 2011 EAD Card production ordered
Oct 26th 2011 EAD Card sent to my home address ( thank God!!)
Oct 28th 2011 EAD Card in hand. Thank you Lord
Nov 14th 2011 I 485 Case transferred to NBC to speed up processing.what does this mean???

waiting.....the whole year of 2012 passes by without a word!!

Apr 17th 2013 I get a letter asking for a I 864W form to complete I485 processing and its orange in colour

Sep 10th 2013 I 485 Interview

I wasnt approved that day, was given another date after the IO requested documents i had that were not very clear to her to be notarized by the court.

Oct 4th 2013 Went back to the IO with the requested documents and she said the decision will be mailed to me.

Nov 1st 2013 I got my I797C USCIS Notification Letter of Approval of my I 485

Nov 8th 2013 Green card got mailed to my address

11.12.13 received my 10 year green card. Thank God. Journey Complete
