I don't think petitioner require to provide this document.

At least I have never heard about it. Are you sure this is a case?

It may be a requirement for marriage in Mexico.

Man, I got married in Mexico in 2006 and it was a hassle and I really can't remember exactly how I got this. They asked for dozens of different things, but if memory serves, I think you can get this from your county clerk. It would be a good place to start in any case.

Timeline:

02/04/2004 - A young Zinker arrives in Mexico to study Spanish and the dating game begins

2004--2005 - Many subsequent visits to Mx ensue to be with my love; engaged in March 2005!

04/??/2005 - I-129F is filed from within the US

06/09/2005 - Zinker moves to Mexico

09/??/2005 - I-129F is approved

10/15/2005 - Interview in Cd. Juarez and subsequently approved for a K1 Visa!..But visa is left in Juarez

10/17/2005 - Due to unexpected pregnancy and a job offer in Mx - we decide not to pursue the visa and it expires :(

01/04/2006 - Married in Mexico

10/09/2011 - Two children later and a comfortable life in Mexico... Preparing to file I-130 in December 2011. Stay Tuned!

I wish I could answer your question but it is different in every country. I know that when I got married in Tunisia, my husband and I had to go to the US Embassy, fill out a form stating that we were single and then it had to be signed and sealed by the Consular. At first when we were planning on getting married in Italy I found out that I and 4 witnesses who knew me personally would have to swear before an Italian Consulate Officer here in the US that I was free to marry. Plus I would have had to go and do the same once in Italy at the US Embassy.

I found this at travel.state.gov

Affidavit of Eligibility to Marry

All civil law countries require proof of legal capacity to enter into a marriage contract in the form of certification by competent authority that no impediment exists to the marriage. No such document exists in the United States. Unless the foreign authorities will allow such a statement to be executed before one of their consular officials in the United States, it will be necessary for the parties to a prospective marriage abroad to execute an affidavit at the American embassy or consulate in the country in which the marriage will occur stating that they are free to marry. This is called an affidavit of eligibility to marry and the fee for the American consular officer''s certification of the affidavit is $55.00, subject to change. Some countries also require witnesses who will execute affidavits to the effect that the parties are free to marry. http://travel.state.gov/law/family_issues/marriage/marriage_589.html

That website is where I first learned what I would need to do to get married in Italy. Unfortunately they don't seem to have any specific instructions for Mexico. Maybe you'll have more luck finding something there. :)

One more thing... Have your soon to be wife ask the Civil Registration Office (where you plan to marry) what they will accept for this and where you can get it. If they want it they should be able to tell you how to get it. That is how we did it in Tunisia. They told us to go to the Embassy and fill out the Certificate of Non-Impediment. Wishing you all the best! :)

In Tunisia we got it from the Embassy in just one day but they aren't really busy there like others. We just went to the Embassy, told them what we needed, payed the fee, filled out the form, waited for the Consular to sign and put his seal on it and left with it. It took us about an hour and a half and most of that time was waiting for the Consular to finish helping someone else.

I am US Citizen, I got married in Honduras and I needed a document showing that I'm single. From what I heard, I couldn't get anything suitable in the US for that. I just went to the US embassy in Tegucigalpa, and from what I remember, they just looked at me and thought I looked single (maiden name etc). I paid about $30 and got a signed document from the embassy. It didn't take very long either.
