I34 Affidavit of Support

Howdy VJ members,

I have been researching the Affidavit of Support. My work situation is a bit differant. I was hoping to get some feedback on if I qualify or need to get a sponsor.

Im a contractor I work 3-5 month contracts with 1-2 month breaks in between. I go through one staffing agency and they have already agreed to write and sign a great letter of recommendation. As well as a letter stating Ive been with them for almost 3 years as a great employee.

My tax returns I made 45k and 65k for the last two years, Im at 40k this year. I have 10k in the bank in savings. No property no stocks/bonds no life inssurance No debt.

So If I file an I34 with my 2 years of tax returns, 5 paystubs, letter from employer, letter from bank showing my depotits and the account being open for the last 5 years, letter from bank showing 10k in savings.

Will this be enough without question ? Or should I go ahead and try to get a sponsor?

Also, I need to get my bank statemetn and the I34 notorised right? I heard I can get that done at my bank, is that true? Anything I should know about getting a document notorised Ive never had to do it before.

If what you say is factual and you can document your income with your tax return, then I'm pretty sure you qualify. You are WELL ABOVE the minimum level of income to sponsor someone.

I don't recall anything about bank statements being notorized.

Yup, factual. I already called the IRS and had them send me copies of my tax returns for the last 2 years. I have them sitting in our file.

Ive just been pretty stressed about it. Because its not technicaly a "Full Time" job. Its Contract work. I just needed reasurance that we shouldnt have any issue.

So the only form I need notorized is the I34?

Also, my love wanted to know - Can the beneficiary file for police records and backround check Before NOA2 or do we have to wait for NOA2? It would be one less thing in our way for setting the interview date.

You don't have to have a full time job, or a job at all, if you have assets to cover the "public charge" requirement, but you admit you do not have assets. While I think you have enough to qualify--given your income for the past 3 years--on your own, to be very safe, you might explore your options of lining up a co-sponsor.

As for the police record, I would suggest you wait until you get your NOA2. You simply don't know when it'll get approved. It would be great if you got approval within two months, but it may take six months or longer. So I'd suggest you wait on that.

I'm not even sure you have to have your I-134 notorized, but I'll defer to someone who knows for certain on that question.

The lack of "Assets" was another concern for me the I34 as I dont have any, I rent an apartment. I have no property unless they consider my car an asset. (I think it is! hah)

Can a bank do the notory? What does that involve, just walking up to my bank manager and asking them to notorize a document? Will they simply agree to that? I have to sign the notorized document in front of the official notory right? Is there other places to get that done besides my bank?

This is unfamiliar territory for me. I apologize if Im a bit off on my questions, just trying to clear it all up before I get to that point!

Read up on the above link to become an expert on notary publics. :)

Call your bank and ask if they can notarize your documnts. I'm pretty sure there are notary publics in every city hall across America.

Your car is indeed an asset, but it needs to have a high resale value. If you're going to use the asset route, you'll need assets which are convertable to cash and their cash value needs to be at least $125,000 USD.
