My wife and i filled for adjustment of my status about 4 week ago. She is an American citizen and i'm an F-1 graduate student. I have so far received receipts and appointment letter for fingerprinting. Today i got a RFE stating "based on the documents submitted with form I-864, Affidavit of support, the joint sponsor, the income did not meet 125% of the federal poverty line for the joint sponsor household". They are asking for evidence of asset ownership by the joint sponsor. Questions,

1) Could it be an overlook since my joint sponsor made $57,000 and has a family of 4? He owns a business.

2) At the moment of filling my wife had a temporary job but now has gotten a permanent job and will be making $60,000 a year. Will submitting a letter from her employer be sufficient to cover everything. We don't want to use joint sponsor anymore. My wife made less than $10,000 in 2010 because she was a full-time student. Should i write a cover letter explaining these changes?

Anyone who had a similar situation?

1.) Possibly. It could also be that even though your co-sponsor makes enough, but is self-employed, it was not reported in his taxes/ he had too many deductions.

2.) Should be ok, as long as you can submit some paystubs. They don't generally like very new jobs though.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
