My wife is a US citizen and applying for the dv lottery

The rules for DCF have changed on August 15th. Right, this poster is correct sam. you will not be allowed to file your petition from here but if she comes here to live with you and you have a child together your chances may be better the next time around. You must now send the petition and forms to chicago lockbox. get a joint lease, bank account, and anything else joint together and take your wife and child to the next interview. i am convinced my sons smile won my husbands visa(just saying) :whistle:

Oh and by the way, having a marriage paper notarized at the ministry of justice is not the same thing as "marrying at the ministry of justice" just thought you should consider that before you spend more money on filing papers. This issue may arise again!

I am idly thinking what an uncool remark dude.

If you had the time to really read what i said you would know why am applying for a visa , the names wouldn't matter cr1-ir1 or the dv lottery, i want to make it easier for my wife , she can't leave 4 kids there and come live in Egypt , or the cps would take her kids and she can't just abandon them and live here , so since i can move there , im moving there to make it easier for her, just stop thinking for once that everybody wants to live in the US and its the dream land.

Its either you are married or you are not. Being married to a US Citizen does not disqualiry you from the visa lottery program :bonk:

I can say one thing, don't apply for both thinking that your chances are greater, no it is not the case. They will assume that you are desperate to immigrate and wish to do so at any means. As for the marriage visa, a copy of your marriage certificate from the ministry of justice with translations is required. If you have one even when the rules state that you can't have one if your marriage age gap is above 15 yrs then i am sure the consular would be wondering who did you pay to get around the rules and that is still a problem for you. I am not being hard on you i am just telling you the truth. If you truly love this woman may Allah make your path to be straight. Allah knows all and sees all, remember that!! :thumbs:

Last time you said they wouldn't let me marry if the gap difference is 20 ...now you are saying 15 ...obviously your not sure...let me tell you this my self ...i live here....i got married as easy as anyone else gets married...there was no problem...i didn't pay anyone as you just assumed ....i have 2 friends of mine that their wifes are older than him and really have a bigger gap and they also didn't pay anyone to do so ....its a free country and we are allowed to marry whoever whenever....if someone else gave you a false information then am sorry about that....and i guess that isn't just here..its everywhere...if you look around in VJ , you will find that many differenct countries have cases like me and more....so i guess someone was bluffing and you believed em...am not trying to be a smart #### or anything ..am trying to be realistic and honest..and for your info....i told my wife i love her before i know her real age or where was she from....so trust me...not every arabian or egyptian man marry a forigner for visa....we love our country more than you can ever imagine..you can ask your husband about that...and if he got there...i can promise you ...in a month or 2 he will be wanting to go back to egypt....i have been outa the country before and a lot of friends have been too and they wants to stay here in egypt but they can't because they didn't build their future here and they wish they never traveled....be careful of what you hear and what you say because your a human and seems to be a good ones and it matters.

I did not say that "I" assumed i said the consular who is well aware of the rules. Most people in this situation i think try for the k1 route. In america you are free to marry anyone of any age and their is no law against it and i suppose that same freedom applies here in egypt just NOT through the ministry of justice. Your whole post was written with the assumption that i am making a judgment or assumption about your relation with your wife and that is simply not true. I am not a judgmental person and leave all matters to ALLAH i was simply stating that the rules say they wont marry you there if your age gap is above (15 yrs i stand corrected)! Although i live here also and my opinion is that nobody seems to follow rules or laws and no one seems to enforce them laws before and since the revolution.

What i am saying to you is, consulars DO consider rules!! They consider the cultural norms as well and its not the normal thing to marry a woman that much older and secondly, most families do not approve of such unions and that is how the consular is going to see it. That does not mean that couples with those age gaps do not truly love each other it just means that the burden on them is much higher to prove a bonafide marriage and i suppose they do that by sending cases back to the usa and delaying things to test the marriage "by fire" so to speak. If you wish to take offense by what i am saying i am only the messenger. My husband(an egyptian as well) is the one who read your post and commented and i was only trying to help you.

As for your statement implying that "I assume" that an egyptian marries for a visa is clearly not reliable seeing the high number of american women who are marrying egyptians(haha me being one of them).

In my opinion, it's an arrogant policy to assume all cases are the same and those of us with true marriages suffer because of those instances of fraud. In my opinion most of the time the marriage is bonafide but some people(like you and your wife) are given a harder time to prove that because of those same reasons. It's not fair! But as the old saying goes "life is not fair."

It does cause me to wonder why you did not respond to the noid or noir that should have been sent to you once the case was sent back. I don't have any advice to give regarding cases being sent back as i have no experience with that. If you did not get anything i would think you would have been trying to contact uscis or nvc to see what can be done in your situation instead of jumping to yet "another" visa attempt. Despite all this, multiple non immigrant attempts, spousal visa attempt and now questioning dv...i still refrained my judgment because as i said before it's not my place but it is the consular's job!!

Well, that was a hell long response but really thank you for taking the time to type it :). As in for the rules...they mighta changed it but i have been married for 2 years now :P gonna tell my wife happy anniversary as soon as she wakes up....as in for the denial ...it never passed NVC...the case never came here...USCIS denied it ...they sent EOIR-29 ...if you go back to page 3 or 4 you will find a link to my denial letter , your free to read it...anyways my lawyer screwed me....USCIS gave me some days to appeal but i didn't want to because i knew it was gonna be a waste of time and money....so thats why am going for another visa...Pray for me ...I wish Allah will help me .

The DV Lottery has the big advanatge of no need to justify your reason to wish to move to the US, you win, assume you meet the requirements, you go.

As in for the rules...they mighta changed it but i have been married for 2 years now :P gonna tell my wife happy anniversary as soon as she wakes up....as in for the denial ...it never passed NVC...the case never came here...USCIS denied it ...they sent EOIR-29 ...if you go back to page 3 or 4 you will find a link to my denial letter , your free to read it...anyways my lawyer screwed me....USCIS gave me some days to appeal but i didn't want to because i knew it was gonna be a waste of time and money....so thats why am going for another visa...Pray for me ...I wish Allah will help me .

Yea i wont apply , i dun think its a good idea , am going to file again in somedays...am gathering everything together and as in for lawyers , I HATE EM ...one of them ruined my chances and you right if i just wanted a green card i woulda have tried other things or married a young girl from sharm el shiekh but i do so love my wife and son and even my step children and they love me .Btw you live in Egypt...if you do...can me and you and your husband meet and when my wife come soon we will all meet together :D it would be awesome to be on the same boat and same country...MASHYYYY :)..by the way thanks for the Dua , I Will pray for you too , just ask what you want :)
